Foodie is more than just a food delivery service; it's a community where passion for great food brings people together. Whether you're a professional foodie, a casual diner, or just looking for new flavors to try, Foodie is here to deliver. However, before you dive in, it’s essential that you review and understand these Terms & Conditions (the "Terms") that govern your use of the Foodie platform. These Terms establish a legally binding agreement between you and Foodie. By using our services, you agree to comply with these Terms, along with our Privacy Policy, and any additional terms that may apply to specific features of the platform.
  1. Agreement Overview
    • Foodie products and services are operated by FOODIE LLC, (hereinafter referred to as "Foodie," "we," or "us"). Before using the services, please carefully read and understand these "Foodie Terms of Use" (hereinafter referred to as "these Terms"), along with all related terms, policies, or guidelines available on our platform. These Terms, together with any additional terms for specific features or functionalities ("Specific Terms"), govern your use of Foodie's products and services. In the event of any conflict between these Terms and the Specific Terms, the provisions of the Specific Terms shall prevail.
    • By accessing or using our Services, you acknowledge that you have read, understood, and agreed to all terms, including the Foodie Privacy Policy. You agree to comply with and be bound by these Terms and any future amendments or modifications. If you do not agree to these Terms, you must immediately cease using our Services. Your continued use of the Services constitutes your acceptance of any updated Terms.
    • Foodie reserves the right, at its sole discretion, to modify or update these Terms at any time without prior notice. Any changes to these Terms will be effective when posted on the App or our website, and your use of the Services after such posting will constitute your acceptance of the modified Terms. We encourage you to review these Terms periodically for any updates.
    • You must be at least 18 years of age or have the consent of a parent or legal guardian to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.
  2. Foodie Services
    • Foodie provides an online platform that allows users to browse menus, place food orders, engage with food vendors, and participate in a community of food enthusiasts. The Services connect customers, food vendors ("Vendors"), and delivery partners ("Delivery Partners") through our platform, as well as social features, such as following food bloggers, sharing reviews, photos, and experiences, and engaging in discussions about food. Foodie acts as an intermediary between customers, food vendors, and delivery partners, but does not prepare, package, or deliver food items directly.
    • The food vendors and delivery partners you engage with through Foodie are independent contractors. Foodie does no t have control over the preparation, quality, safety, or delivery of food. The transactions between users, food vendors, and delivery partners are solely the responsibility of the parties involved, and Foodie is not liable for any issues arising from those transactions.
    • While Foodie strives to provide a seamless platform for Users, we make no representation or warranty regarding the continuous availability of the Services. The accuracy of information provided by vendors, users, or other Bloggers is not guaranteed, and we do not take responsibility for inaccuracies, outdated content, or misleading claims. Additionally, the platform may experience temporary downtime due to maintenance, technical upgrades, or unforeseen circumstances beyond our control. Foodie reserves the right to modify, update, or suspend certain features as necessary to improve the user experience or comply with legal and operational requirements.
 
  1. Account Registration and Security
    • The Services are primarily intended for users aged 18 years or older. If you are under 18, you may only use the Services under the supervision and with the consent of a legal guardian. Foodie fully understands the importance of protecting minors and will take corresponding protective measures in accordance with legal requirements and industry mainstream practices. If it is discovered that an account is being used in violation of this provision, we reserve the right to suspend or terminate the account without notice.
    • In order to use the Services, you must create a user account. During registration, you will be asked to provide personal information, such as your name, email address, phone number, and payment details. You are responsible for maintaining the confidentiality of your login credentials (username and password) and for all activities under your account. You agree to notify Foodie immediately if you believe your account has been compromised or if unauthorized access has occurred.
    • If the information you submit are inaccurate, untrue, non-standard, or if there is a reason for Foodie to suspect them as incorrect, false, or illegal, we reserve the right to refuse to provide you with related functions. As a result, you may be unable to use this platform and related services or may face restrictions on certain functions during use. Your account is your credential for logging in and using the Services. The account is non-transferable, non-giftable, and non-inheritable.
    • When you register and use an account, you must commit and guarantee that:
  2. You take full responsibility for the authenticity, legality, and validity of the registration information, update the registration information promptly, and must not register an account or use the Services on behalf of others;
  3. Safely keep your account and password and take legal responsibility for all activities under that account;
  4. Do not maliciously register accounts, including but not limited to frequent or bulk registration;
  5. Do not transfer, lend, rent, or provide your account to others in any form.
    • Foodie reserves the right, in its sole discretion, to suspend, terminate, or restrict your access to the Services if we believe you have violated any of these Terms, engaged in fraudulent activity, or otherwise acted in a manner detrimental to the integrity of the platform. You may terminate your account at any time by following the instructions provided within the platform.
    • If you lose your account, forget your password, or leak your verification code, you can follow the procedure to appeal for recovery in a timely manner. We especially remind you to properly safeguard your account, password, and verification code. After using them, you shall log out securely. You will bear full r esponsibility for any losses caused by the leakage of your account or password. If users discover any unauthorized use of their accounts, they shall immediately notify us, and we will provide the fullest cooperation and handling.
    • To delete your account, you may request deletion through the settings section of the Foodie platform. Please note that deleting your account will remove your personal data, though certain information may be retained as required by law, for the establishment, exercise, or defense of legal claims, or to comply with legal obligations.
 
  1. User Obligations
    • When using the Services provided by Foodie, users shall comply with these Terms and adhere to all applicable laws, regulations, platform policies, the principles of voluntariness, equality, fairness, and good faith. Users shall not use the service to infringe on the legal rights of others or seek unjust benefits, nor shall they disrupt the normal order of the internet platform. You are required to provide accurate order and delivery information, respect the rights of other users, Vendors, and Delivery Partners, and ensure timely payment for services.
    • Users are expressly prohibited from engaging in the following activities:
      1. Placing fraudulent orders or using unauthorized payment methods;
      2. Abusing promotional offers, manipulating ratings or reviews, or submitting false documentation;
      3. Interfering with the platform’s operations, including using bots, hacking, reverse engineering, or circumventing security measures;
      4. Engaging in harassment, abuse, or discrimination against any platform participants;
      5. Sharing explicit, offensive, or inappropriate content through the platform.
      6. Criminal or tortious activity, including fraud, harassment, stalking, spamming, copyright infringement, or theft of trade secrets;
      7. Advertising or soliciting other users to buy/sell products/services without registering as a vendor;
      8. Systematic retrieval of data to create databases/directories without permission;
      9. Impersonating other users, employees, or representatives of Foodie;
    • To fulfill legal and compliance requirements, Foodie has the right to use technical means to review the behavior and information of users using the Services.
 
  1. Order Processing and Delivery
    • Orders placed through the Foodie platform become binding upon confirmation by the Vendor. Users are responsible for reviewing all order d etails, including item descriptions, quantities, pricing, and any special instructions, prior to submission. Orders are subject to availability, and Vendors retain the right to decline orders due to stock shortages, technical errors, policy violations, or other operational constraints. By placing an order, users authorize Foodie to share relevant information with Vendors and Delivery Partners to facilitate the transaction. Users must comply with all applicable Vendor policies and any additional requirements specified at the time of placing an order.
    • Vendors are required to confirm order acceptance within (1) one minute of receipt. If no confirmation is received within this timeframe, users will be notified and may cancel the order without charge. Users may also cancel orders before Vendor confirmation at no cost. Users may cancel their order within thirty (30) seconds of placing it without any charges, regardless of whether the Vendor has accepted the order. After this 30-second period, cancellations will be subject to the Vendor’s refund policy and Foodie’s terms, and may result in full or partial charges depending on the status of the order at the time of cancellation.
    • Requests for modifications or cancellations must be submitted promptly and before the Vendor confirms the order. Such requests are subject to Vendor approval and may result in additional charges. Foodie will notify users of any applicable fees before processing modifications or cancellations. Refunds for canceled or modified orders will be issued in accordance with Foodie’s established Refund Policy, and refund processing times may vary depending on the payment method used. Foodie reserves the right to deduct applicable fees before issuing refunds.
    • Vendors retain the right to cancel orders at their discretion, including but not limited to instances of inventory shortages, technical failures, or force majeure events. In such cases, affected users will be notified promptly, and any payments made will be refunded in accordance with the refund policy.
    • Estimated delivery times displayed on the platform are for reference only and are not guaranteed. Various external factors, including weather conditions, high order volumes, traffic disruptions, and unforeseen technical issues, may affect actual delivery times. While Foodie and its Delivery Partners strive to provide timely service, they are not liable for delays beyond reasonable control. Users must ensure that delivery addresses are accurate, accessible, and safe for delivery. Additional charges may apply for deliveries to remote or restricted-access areas.
    • To ensure successful delivery, users must be available at the specified delivery location at the time of arrival. If the recipient is unresponsive or unreachable within ten (10) minutes of the delivery attempt, the order may be canceled at the user’s expense, without eligibility for a refund. If users opt for contactless delivery, they assume responsibility for the order once it is placed at the designated drop-off location.
    • Upon receipt, users are encouraged to inspect their orders immediately. Foodie is not responsible for the condition, quality, or safety of items post-delivery. If an order is incomplete, incorrect, or defective, users must report the issue to customer support promptly, providing any necessary evidence such as photographs, for resolution. Foodie will assess claims in accordance with its policies and may issue refunds or credits at its discretion.
 
  1. Delivery and Pick-Up Policies
    • Foodie facilitates food deliveries through third-party vendors and delivery partners ("Delivery Partners"). The Services provided by Foodie are limited to the facilitation of the order and coordination of the delivery process, but Foodie does not directly control the delivery process itself. The estimated delivery time provided by Foodie at the time of order placement is an approximation based on factors such as the vendor's preparation time, the distance between the vendor and the delivery address, current traffic conditions, and other relevant considerations. However, the actual delivery time may vary due to factors beyond Foodie’s control, including, but not limited to: a) Unforeseen traffic delays or road conditions; b) Adverse weather conditions (e.g., storms, heavy rain, or snow); c) Vendor delays in food preparation or fulfillment; d) Delivery Partner delays due to personal or logistical factors.
    • By using the Services, you acknowledge and agree that these estimated delivery times are not guaranteed and that Foodie shall not be held liable for delays caused by any factors outside its reasonable control. You further agree that Foodie’s delivery time estimates are purely for informational purposes and may be subject to change.
    • To ensure successful delivery of your order, you are solely responsible for ensuring that your delivery address is accurate, accessible, and available at the time of delivery. You must ensure that you, or an authorized representative, is present at the delivery location to receive the order at the expected time of delivery. In the event that a delivery attempt fails due to the following circumstances, Foodie shall have no liability, and you will not be entitled to a refund or any form of compensation: a) Incorrect or incomplete delivery address provided at the time of order; b) User unavailability or failure to respond to the Delivery Partner's attempts to contact you at the delivery address; c) User failure to provide necessary access to the delivery location (e.g., locked gates, inaccessible buildings, or restricted entry points); d) Failure to provide a valid contact number or a reachable point of contact for the Delivery Partner.
In such cases, Foodie reserves the right, at its sole discretion, to cancel the order or charge you a cancellation fee. If the order is canceled due to failed delivery, no refund will be issued, unless otherwise specified in our Refund Policy
  • For orders designated for pick-up ("Pick-Up Orders"), users are responsible for collecting the order directly from the vendor’s premises at the designated pick-up location. The vendor will prepare the order and have it ready for collection at the scheduled time. However, the vendor is only obligated to hold your Pick-Up Order for a limited period of time. The following terms apply to Pick-Up Orders:
    1. The vendor will hold the Pick-Up Order for a maximum of thirty (30) minutes after the designated pick-up time.
    2. If you fail to collect your order within this holding period, the vendor may, at their discretion, choose not to release the order or provide a replacement.
    3. After the holding period expires, the vendor is not obligated to offer any form of replacement, refund, or compensation for any dissatisfaction arising from the failure to pick up the order in time.
Foodie is not responsible for any delays or issues caused by failure to pick up the order in a timely manner. You agree that Foodie will not be held liable for any loss, damage, or inconvenience resulting from delays in picking up your order.
  • Once an order has been submitted and payment processed, it is generally considered final and non-modifiable. However, in cases where modifications or cancellations are permitted, you must act promptly. The following policies apply:
    1. Delivery Orders: If you wish to cancel or modify a delivery order after it has been placed, you must contact Foodie support immediately. Cancellations or modifications to orders may not be possible once the vendor has accepted the order or the Delivery Partner is en route to the delivery location. If cancellation or modification is still possible, Foodie will make reasonable efforts to accommodate your request, but Foodie does not guarantee the ability to cancel or alter an order once it is in progress.
    2. Pick-Up Orders: Once a pick-up order has been prepared by the vendor, cancellations or modifications are not allowed. You are encouraged to ensure the accuracy of your order before finalizing it.
 
  1. Price and Payment Methods
    • All prices displayed on the Foodie platform include applicable taxes, including sales tax, and any applicable service charges such as delivery fees, where relevant. Pricing may vary based on location, Vendor pricing policies, and promotions. Foodie endeavors to ensure that all listed prices are accurate and up to date; however, if an obvious pricing error is identified, Foodie reserves the right to cancel the affected order and issue a refund, even after order confirmation. Users will be notified of any pricing discrepancies, and in cases where adjustments are necessary, they will have the right to cancel their order before proceeding with the modified amount.
    • Foodie supports multiple secure payment methods, including credit/debit cards and digital platform wallets. Upon order confirmation, the corresponding payment amount is authorized and held in the user’s account until the order is completed. Payments are securely processed through third-party payment providers, ensuring compliance with financial regulations and industry security standards. In cases where payment processing issues arise due to banking restrictions, insufficient funds, or technical errors, the order may be delayed or canceled at Foodie’s discretion.
    • Users are solely responsible for verifying their payment details and ensuring they have sufficient funds before placing an order. Foodie does not store sensitive payment information but facilitates transactions through its secure payment processing partners. Users must ensure their payment credentials remain confidential and are not shared with third parties. Foodie shall not be liable for any unauthorized transactions resulting from user negligence, including account security breaches or fraudulent activity by third parties.
    • Refunds, where applicable, will be processed through crediting the refund amount to the user’s Foodie wallet, at its discretion. Refund timelines vary depending on the payment provider, and Foodie is not responsible for delays caused by banking institutions or third-party financial services.
    • Foodie reserves the right to modify its pricing structures, service charges, and available payment methods at any time to reflect operational costs, economic conditions, or changes in Vendor pricing models. Any such modifications will be communicated through platform notifications, and continued use of the service constitutes acceptance of the updated terms.
 
  1. Rider Tips
    • When placing an order on the Foodie platform, users have the option to provide a tip to the rider responsible for delivering their order (“Rider Tip”). Tipping is entirely voluntary but serves as a way to acknowledge and reward the rider’s service. If a user chooses to tip, the selected amount will be collected at checkout using the same payment method applied to the order. The Rider Tip is securely processed and held until the successful completion of the delivery, at which point the full amount is transferred to the rider.
    • Foodie ensures that 100% of the Rider Tip goes directly to the rider without deductions. The tipping process is designed to be seamless, and users may choose from preset tip amounts or enter a custom amount, subject to minimum and maximum limits. Tips may be adjusted before the order is confirmed but cannot be modified once the order is placed.
    • If an order is canceled before it has been assigned to a rider or before the delivery process has commenced, the Rider Tip will be automatically refunded to the user’s Foodie wallet. However, once the rider has picked up the order from the Vendor or has begun the delivery process, the Rider Tip becomes non-refundable, even if the order is later canceled for reasons beyond the rider’s control.
    • In the event of failed deliveries due to user unavailability, incorrect addresses, or other user-related factors, the Rider Tip remains non-refundable, as the rider has still provided the delivery service up to the extent possible. If an issue arises related to service quality or rider misconduct, users may report the incident through Foodie’s customer support, which will assess complaints on a case-by-case basis. Foodie reserves the right to issue discretionary adjustments or compensatory credits in exceptional circumstances.
    • By using Foodie’s tipping feature, users acknowledge and agree that Rider Tips are separate from delivery fees and do not influence delivery prioritization or service quality. Foodie does not mandate tipping and does not impose any penalties on users who choose not to tip.
 
  1. Intellectual Property Rights
    • All intellectual property associated with the platform, including software, algorithms, content, graphics, trademarks, proprietary technology, and unique features such as social networking functionalities, remains the exclusive property of Foodie or its licensors. Users are granted a limited, revocable, non-exclusive, and non-transferable license to access and use the platform solely for its intended purposes, subject to compliance with these Terms.
    • Users are prohibited from copying, reproducing, distributing, reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying components of the platform. Any unauthorized use of Foodie’s intellectual property may result in immediate suspension or termination of access and potential legal action.
    • Without our permission, you or your end users shall not use any trademarks, service marks, trade names, domain names, website names, company logos (LOGOs), URLs, or other prominent brand features related to the Services, including but not limited to "Foodie”, in any way, either singly or in combination. You are not allowed to display, use, or apply for registration of trademarks, domain names, etc., related to the aforementioned terms in any way, and you shall not perform acts that expressly or implicitly indicate the right to display, use, or otherwise deal with these identifiers to others.
 
  1. Data Privacy and Protection
    • The collection, processing, and storage of personal data through our platform are governed by the Foodie Privacy Policy. This includes but is not limited to data related to account registration, order details, delivery locations, communication records, and user preferences.
    • Foodie employs industry-standard security measures to safeguard personal data, including encryption, access controls, regular security audits, and incident response protocols. Despite these measures, users acknowledge and accept that no system is entirely immune to security risks. Foodie is not liable for unauthorized access, alteration, or destruction of user data resulting from circumstances beyond reasonable control.
    • Users are responsible for maintaining the confidentiality of their account credentials and promptly reporting any suspected unauthorized access. By using the Services, users consent to the collection, use, and sharing of their data as outlined in the Privacy Policy.
 
  1. Advertisement Policy
    • Foodie may display advertisements from third-party partners, sponsors, or affiliates (“Advertisers”) as part of the Services. These advertisements may appear on the platform, in emails, or within other communications.
    • Advertisers are solely responsible for:
      1. Ensuring their content complies with all applicable laws, including Jordanian consumer protection, anti-discrimination, and e-commerce regulations.
      2. Accurately representing products/services and disclosing material terms (e.g., pricing, eligibility).
      3. Labeling sponsored or promotional content clearly (e.g., using “Ad,” “Sponsored,” or “Promotion”).
    • Users can report misleading, offensive, or illegal advertisements directly through the platform. Foodie will investigate and remove non-compliant ads within 48 hours.
    • Foodie does not endorse Advertisers or their products/services. We are not liable for disputes arising from third-party ads.
 
  1. Disclaimer of Warranties, Limitations of Liability, and Indemnity
    • Nothing in these terms shall affect any statutory rights that you cannot contractually agree to alter or waive and are legally always entitled to as a consumer.
    • In response to your violation of these Terms or other service terms, Foodie reserves the right to independently judge and take measures against you, including issuing warnings, setting deadlines for correction, restricting account functions, suspending usage, closing accounts, prohibiting re-registration, deleting relevant content, etc., without the need for prior notification. We have the right to announce the results of the actions taken and, based on the actual circumstances, decide whether to restore usage. For behaviors suspected of violating laws and regulations or involving illegal activities, relevant records will be retained, and reports will be made to the competent authorities in accordance with the law, cooperating with their investigations. You shall be solely responsible for any legal liabilities, claims, demands, or losses asserted by third parties resulting therefrom, and you shall compensate us for any losses incurred, including litigation fees, arbitration fees, attorney fees, notary fees, announcement fees, appraisal fees, travel expenses, investigation and evidence collection fees, compensation, liquidated damages, settlement costs, and administrative fines incurred in protecting our rights.
    • Foodie acts solely as an intermediary platform. To the fullest extent permitted by law, we exclude liability for:
      1. Food quality, preparation, or safety.
      2. Delivery delays, errors, or damages caused by Delivery Partners or external factors.
      3. Third-party actions, including Advertisers or linked websites.
      4. Indirect, consequential, or punitive damages.
    • You agree to indemnify, defend, and hold us and our affiliates and licensors (if any) harmless against any liabilities, damages, and costs (including reasonable attorneys' fees) payable to a third party arising out of a breach by you or any user of your account of these Terms, your violation of all applicable laws and regulations or third party rights, your fraud or other illegal acts, or your intentional misconduct or gross negligence, to the extent permitted by the applicable law.
 
  1. Governing Law and Dispute Resolution
    • These Terms are governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan without regard to conflict of law principles.
    • All disputes arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Central Amman (Qasr Al Adl).
 
  1. Modifications to Terms
Foodie reserves the right to update or modify these Terms at any time. Changes will become effective upon posting to the platform. Users are encouraged to review the Terms regularly. Continued use of the Services constitutes acceptance of any updated Terms.

You will bear full responsibility for any losses caused by the leakage of your account or password. If users discover any unauthorized use of their accounts, they shall immediately notify us, and we will provide the fullest cooperation and handling.
    3. To delete your account, you may request deletion through the settings section of the Foodie platform. Please note that deleting your account will remove your personal data, though certain information may be retained as required by law, for the establishment, exercise, or defense of legal claims, or to comply with legal obligations.

User Obligations

    1. When using the Services provided by Foodie, users shall comply with these Terms and adhere to all applicable laws, regulations, platform policies, the principles of voluntariness, equality, fairness, and good faith. Users shall not use the service to infringe on the legal rights of others or seek unjust benefits, nor shall they disrupt the normal order of the internet platform. You are required to provide accurate order and delivery information, respect the rights of other users, Vendors, and Delivery Partners, and ensure timely payment for services.
    2. Users are expressly prohibited from engaging in the following activities:
      1.  Placing fraudulent orders or using unauthorized payment methods;
      2. Abusing promotional offers, manipulating ratings or reviews, or submitting false documentation;
      3. Interfering with the platform’s operations, including using bots, hacking, reverse engineering, or circumventing security measures;
      4. Engaging in harassment, abuse, or discrimination against any platform participants;
      5. Sharing explicit, offensive, or inappropriate content through the platform.
      6. Criminal or tortious activity, including fraud, harassment, stalking, spamming, copyright infringement, or theft of trade secrets;
      7. Advertising or soliciting other users to buy/sell products/services without registering as a vendor;
      8. Systematic retrieval of data to create databases/directories without permission;
      9. Impersonating other users, employees, or representatives of Foodie;
    3. To fulfill legal and compliance requirements, Foodie has the right to use technical means to review the behavior and information of users using the Services.

Order Processing and Delivery

    1. Orders placed through the Foodie platform become binding upon confirmation by the Vendor. Users are responsible for reviewing all order details, including item descriptions, quantities, pricing, and any special instructions, prior to submission. Orders are subject to availability, and Vendors retain the right to decline orders due to stock shortages, technical errors, policy violations, or other operational constraints. By placing an order, users authorize Foodie to share relevant information with Vendors and Delivery Partners to facilitate the transaction. Users must comply with all applicable Vendor policies and any additional requirements specified at the time of placing an order.
    2. Vendors are required to confirm order acceptance within (1) one minute of receipt. If no confirmation is received within this timeframe, users will be notified and may cancel the order without charge. Users may also cancel orders before Vendor confirmation at no cost. Users may cancel their order within thirty (30) seconds of placing it without any charges, regardless of whether the Vendor has accepted the order. After this 30-second period, cancellations will be subject to the Vendor’s refund policy and Foodie’s terms, and may result in full or partial charges depending on the status of the order at the time of cancellation.
    3. Requests for modifications or cancellations must be submitted promptly and before the Vendor confirms the order. Such requests are subject to Vendor approval and may result in additional charges. Foodie will notify users of any applicable fees before processing modifications or cancellations. Refunds for canceled or modified orders will be issued in accordance with Foodie’s established Refund Policy, and refund processing times may vary depending on the payment method used. Foodie reserves the right to deduct applicable fees before issuing refunds.
    4. Vendors retain the right to cancel orders at their discretion, including but not limited to instances of inventory shortages, technical failures, or force majeure events. In such cases, affected users will be notified promptly, and any payments made will be refunded in accordance with the refund policy.
    5. Estimated delivery times displayed on the platform are for reference only and are not guaranteed. Various external factors, including weather conditions, high order volumes, traffic disruptions, and unforeseen technical issues, may affect actual delivery times. While Foodie and its Delivery Partners strive to provide timely service, they are not liable for delays beyond reasonable control. Users must ensure that delivery addresses are accurate, accessible, and safe for delivery. Additional charges may apply for deliveries to remote or restricted-access areas.
    6. To ensure successful delivery, users must be available at the specified delivery location at the time of arrival. If the recipient is unresponsive or unreachable within ten (10) minutes of the delivery attempt, the order may be canceled at the user’s expense, without eligibility for a refund. If users opt for contactless delivery, they assume responsibility for the order once it is placed at the designated drop-off location.
    7. Upon receipt, users are encouraged to inspect their orders immediately. Foodie is not responsible for the condition, quality, or safety of items post-delivery. If an order is incomplete, incorrect, or defective, users must report the issue to customer support promptly, providing any necessary evidence such as photographs, for resolution. Foodie will assess claims in accordance with its policies and may issue refunds or credits at its discretion.

Delivery and Pick-Up Policies

        1. Foodie facilitates food deliveries through third-party vendors and delivery partners ("Delivery Partners"). The Services provided by Foodie are limited to the facilitation of the order and coordination of the delivery process, but Foodie does not directly control the delivery process itself. The estimated delivery time provided by Foodie at the time of order placement is an approximation based on factors such as the vendor's preparation time, the distance between the vendor and the delivery address, current traffic conditions, and other relevant considerations. However, the actual delivery time may vary due to factors beyond Foodie’s control, including, but not limited to: a) Unforeseen traffic delays or road conditions; b) Adverse weather conditions (e.g., storms, heavy rain, or snow); c) Vendor delays in food preparation or fulfillment; d) Delivery Partner delays due to personal or logistical factors.
        2. By using the Services, you acknowledge and agree that these estimated delivery times are not guaranteed and that Foodie shall not be held liable for delays caused by any factors outside its reasonable control. You further agree that Foodie’s delivery time estimates are purely for informational purposes and may be subject to change.
        3. To ensure successful delivery of your order, you are solely responsible for ensuring that your delivery address is accurate, accessible, and available at the time of delivery. You must ensure that you, or an authorized representative, is present at the delivery location to receive the order at the expected time of delivery. In the event that a delivery attempt fails due to the following circumstances, Foodie shall have no liability, and you will not be entitled to a refund or any form of compensation: a) Incorrect or incomplete delivery address provided at the time of order; b) User unavailability or failure to respond to the Delivery Partner's attempts to contact you at the delivery address; c) User failure to provide necessary access to the delivery location (e.g., locked gates, inaccessible buildings, or restricted entry points); d) Failure to provide a valid contact number or a reachable point of contact for the Delivery Partner.

Price and Payment Methods

    1. All prices displayed on the Foodie platform include applicable taxes, including sales tax, and any applicable service charges such as delivery fees, where relevant. Pricing may vary based on location, Vendor pricing policies, and promotions. Foodie endeavors to ensure that all listed prices are accurate and up to date; however, if an obvious pricing error is identified, Foodie reserves the right to cancel the affected order and issue a refund, even after order confirmation. Users will be notified of any pricing discrepancies, and in cases where adjustments are necessary, they will have the right to cancel their order before proceeding with the modified amount.
    2. Foodie supports multiple secure payment methods, including credit/debit cards and digital platform wallets. Upon order confirmation, the corresponding payment amount is authorized and held in the user’s account until the order is completed. Payments are securely processed through third-party payment providers, ensuring compliance with financial regulations and industry security standards. In cases where payment processing issues arise due to banking restrictions, insufficient funds, or technical errors, the order may be delayed or canceled at Foodie’s discretion.
    3.  Users are solely responsible for verifying their payment details and ensuring they have sufficient funds before placing an order. Foodie does not store sensitive payment information but facilitates transactions through its secure payment processing partners. Users must ensure their payment credentials remain confidential and are not shared with third parties. Foodie shall not be liable for any unauthorized transactions resulting from user negligence, including account security breaches or fraudulent activity by third parties.
    4. Refunds, where applicable, will be processed through crediting the refund amount to the user’s Foodie wallet, at its discretion. Refund timelines vary depending on the payment provider, and Foodie is not responsible for delays caused by banking institutions or third-party financial services.
    5. Foodie reserves the right to modify its pricing structures, service charges, and available payment methods at any time to reflect operational costs, economic conditions, or changes in Vendor pricing models. Any such modifications will be communicated through platform notifications, and continued use of the service constitutes acceptance of the updated terms.

Rider Tips

    1. When placing an order on the Foodie platform, users have the option to provide a tip to the rider responsible for delivering their order (“Rider Tip”). Tipping is entirely voluntary but serves as a way to acknowledge and reward the rider’s service. If a user chooses to tip, the selected amount will be collected at checkout using the same payment method applied to the order. The Rider Tip is securely processed and held until the successful completion of the delivery, at which point the full amount is transferred to the rider.
    2. Foodie ensures that 100% of the Rider Tip goes directly to the rider without deductions. The tipping process is designed to be seamless, and users may choose from preset tip amounts or enter a custom amount, subject to minimum and maximum limits. Tips may be adjusted before the order is confirmed but cannot be modified once the order is placed.
    3. If an order is canceled before it has been assigned to a rider or before the delivery process has commenced, the Rider Tip will be automatically refunded to the user’s Foodie wallet. However, once the rider has picked up the order from the Vendor or has begun the delivery process, the Rider Tip becomes non-refundable, even if the order is later canceled for reasons beyond the rider’s control.
    4. In the event of failed deliveries due to user unavailability, incorrect addresses, or other user-related factors, the Rider Tip remains non-refundable, as the rider has still provided the delivery service up to the extent possible. If an issue arises related to service quality or rider misconduct, users may report the incident through Foodie’s customer support, which will assess complaints on a case-by-case basis. Foodie reserves the right to issue discretionary adjustments or compensatory credits in exceptional circumstances.
    5. By using Foodie’s tipping feature, users acknowledge and agree that Rider Tips are separate from delivery fees and do not influence delivery prioritization or service quality. Foodie does not mandate tipping and does not impose any penalties on users who choose not to tip.

Intellectual Property Rights

    1.  All intellectual property associated with the platform, including software, algorithms, content, graphics, trademarks, proprietary technology, and unique features such as social networking functionalities, remains the exclusive property of Foodie or its licensors. Users are granted a limited, revocable, non-exclusive, and non-transferable license to access and use the platform solely for its intended purposes, subject to compliance with these Terms.
    2. Users are prohibited from copying, reproducing, distributing, reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying components of the platform. Any unauthorized use of Foodie’s intellectual property may result in immediate suspension or termination of access and potential legal action.
    3. Without our permission, you or your end users shall not use any trademarks, service marks, trade names, domain names, website names, company logos (LOGOs), URLs, or other prominent brand features related to the Services, including but not limited to "Foodie”, in any way, either singly or in combination. You are not allowed to display, use, or apply for registration of trademarks, domain names, etc., related to the aforementioned terms in any way, and you shall not perform acts that expressly or implicitly indicate the right to display, use, or otherwise deal with these identifiers to others.

Data Privacy and Protection

    1. The collection, processing, and storage of personal data through our platform are governed by the Foodie Privacy Policy. This includes but is not limited to data related to account registration, order details, delivery locations, communication records, and user preferences.
    2. Foodie employs industry-standard security measures to safeguard personal data, including encryption, access controls, regular security audits, and incident response protocols. Despite these measures, users acknowledge and accept that no system is entirely immune to security risks. Foodie is not liable for unauthorized access, alteration, or destruction of user data resulting from circumstances beyond reasonable control.
    3. Users are responsible for maintaining the confidentiality of their account credentials and promptly reporting any suspected unauthorized access. By using the Services, users consent to the collection, use, and sharing of their data as outlined in the Privacy Policy.

Advertisement Policy

    1. Foodie may display advertisements from third-party partners, sponsors, or affiliates (“Advertisers”) as part of the Services. These advertisements may appear on the platform, in emails, or within other communications.
    2. Advertisers are solely responsible for:
      1. Ensuring their content complies with all applicable laws, including Jordanian consumer protection, anti-discrimination, and e-commerce regulations.
      2.  Accurately representing products/services and disclosing material terms (e.g., pricing, eligibility).
      3. Labeling sponsored or promotional content clearly (e.g., using “Ad,” “Sponsored,” or “Promotion”).
    3. Users can report misleading, offensive, or illegal advertisements directly through the platform. Foodie will investigate and remove non-compliant ads within 48 hours.
    4. Foodie does not endorse Advertisers or their products/services. We are not liable for disputes arising from third-party ads.

Disclaimer of Warranties, Limitations of Liability, and Indemnity

    1. Nothing in these terms shall affect any statutory rights that you cannot contractually agree to alter or waive and are legally always entitled to as a consumer.
    2. In response to your violation of these Terms or other service terms, Foodie reserves the right to independently judge and take measures against you, including issuing warnings, setting deadlines for correction, restricting account functions, suspending usage, closing accounts, prohibiting re-registration, deleting relevant content, etc., without the need for prior notification. We have the right to announce the results of the actions taken and, based on the actual circumstances, decide whether to restore usage. For behaviors suspected of violating laws and regulations or involving illegal activities, relevant records will be retained, and reports will be made to the competent authorities in accordance with the law, cooperating with their investigations. You shall be solely responsible for any legal liabilities, claims, demands, or losses asserted by third parties resulting therefrom, and you shall compensate us for any losses incurred, including litigation fees, arbitration fees, attorney fees, notary fees, announcement fees, appraisal fees, travel expenses, investigation and evidence collection fees, compensation, liquidated damages, settlement costs, and administrative fines incurred in protecting our rights.
    3. Foodie acts solely as an intermediary platform. To the fullest extent permitted by law, we exclude liability for:
      1. Food quality, preparation, or safety.
      2. Delivery delays, errors, or damages caused by Delivery Partners or external factors.
      3. Third-party actions, including Advertisers or linked websites.
      4. Indirect, consequential, or punitive damages.
    4.  You agree to indemnify, defend, and hold us and our affiliates and licensors (if any) harmless against any liabilities, damages, and costs (including reasonable attorneys' fees) payable to a third party arising out of a breach by you or any user of your account of these Terms, your violation of all applicable laws and regulations or third party rights, your fraud or other illegal acts, or your intentional misconduct or gross negligence, to the extent permitted by the applicable law.

Governing Law and Dispute Resolution

    1. These Terms are governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan without regard to conflict of law principles.
    2. All disputes arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Central Amman (Qasr Al Adl).

Modifications to Terms

Foodie reserves the right to update or modify these Terms at any time. Changes will become effective upon posting to the platform. Users are encouraged to review the Terms regularly. Continued use of the Services constitutes acceptance of any updated Terms.

As a Food Blogger, you have the opportunity to shape the conversation, offer expert recommendations, and bring the best food experiences to a wider audience. However, before you dive in, it’s essential that you review and understand these Terms & Conditions (the "Blogger Terms") that govern your use of the Foodie platform. These Terms, together with any additional terms for specific features or functionalities ("Specific Terms"), govern your use of Foodie's products and services. In the event of any conflict between these Terms and the Specific Terms, the provisions of the Specific Terms shall prevail.
    • By accessing or using our Services, you acknowledge that you have read, understood, and agreed to all terms, including the Foodie Privacy Policy. You agree to comply with and be bound by these Terms and any future amendments or modifications. If you do not agree to these Terms, you must immediately cease using our Services. Your continued use of the Services constitutes your acceptance of any updated Terms.
    • Foodie reserves the right, at its sole discretion, to modify or update these Terms at any time without prior notice.     • Foodie provides an interactive online platform where Bloggers can share their culinary experiences, connect with food vendors, and engage with a community of fellow food enthusiasts. Through Foodie, Bloggers can publish written reviews, post photos and videos, create reels and go live, share personal dining experiences, and provide expert recommendations. The platform also allows Bloggers to interact with users by responding to comments, participating in discussions, and offering insights into food trends, dining options, and must-try dishes. Foodie is not just a content-sharing platform but a social space where food storytelling thrives.
    • The food vendors you feature, review, or collaborate with through Foodie operate as independent entities. Foodie does not influence the quality, preparation, pricing, or availability of their offerings. Any partnerships, sponsorships, or collaborations between Bloggers and vendors are the sole responsibility of the involved parties. Foodie is not liable for any disputes, misrepresentations, or transactions between Bloggers and vendors, nor does it guarantee any business engagements, incentives, or compensations resulting from such relationships.
    • While Foodie strives to provide a seamless platform for Bloggers, we make no representation or warranty regarding the continuous availability of the Services. The accuracy of information provided by vendors, users, or other Bloggers is not guaranteed, and we do not take responsibility for inaccuracies, outdated content, or misleading claims. Additionally, the platform may experience temporary downtime due to maintenance, technical upgrades, or unforeseen circumstances beyond our control. Foodie reserves the right to modify, update, or suspend certain features as necessary to improve the user experience or comply with legal and operational requirements.
 
  1. Account Registration and Security
    • To join the Foodie Blogger community and contribute to our social food hub, you must meet the following eligibility criteria:
      1. You must be at least 18 years of age or the legal age of majority in your jurisdiction. Foodie fully understands the importance of protecting minors and will take corresponding protective measures in accordance with legal requirements and industry mainstream practices. If it is discovered that an account is being used in violation of this provision, we reserve the right to suspend or terminate the account without notice.
      2. You must maintain an active Foodie blogger account in good standing, free of violations under the Foodie Bloggers Terms of Use. This includes and ensure that all content, including reviews, recommendations, and ratings, is honest and based on genuine experiences. Interact respectfully and professionally with Vendors fellow bloggers, and the Foodie community. Avoid plagiarism, disclose any sponsored content or partnerships, and maintain transparency in all blogging activities
      3. You must demonstrate a consistent ability to create original, high-quality content that aligns with Foodie’s mission. This includes reviews, Reels, photos, ratings, and other social features that reflect genuine experiences and expertise.
    • To register as a Foodie Blogger, follow these steps:
      1. Begin by creating a standard Foodie user account. During registration, you are required to provide accurate personal information as outlined in the Privacy Policy, including your first name, last name, email address, phone number, GPS location (for mobile users), and delivery address (if applicable). This information ensures seamless order tracking, personalized recommendations, and secure communication between you, Vendors, and the Foodie team.
      2. After establishing your user account, navigate to the “Profile” menu within the Foodie app. Select the “Upgrade to Blogger” option, which will prompt you to submit a formal request for Blogger status. This feature is designed to distinguish casual users from dedicated content creators. As part of your application, you will be required to submit Your social media profile links to demonstrate your expertise and alignment with Foodie’s standards. Acceptable submissions include: Reels and photos showcasing food experiences, written reviews. The Foodie curation team will evaluate submissions based on originality, visual and editorial quality, and adherence to Foodie’s content guidelines.
      3. Bloggers who demonstrate exceptional engagement and content quality may qualify for Verified Blogger status, a premium designation offering additional benefits.
    • Users who meet the Verified Blogger eligibility criteria, including order activity and content quality standards, will receive a notification inviting them to apply for verification. To complete the upgrade process, eligible users must navigate to the “Get Verified Profile” section under “Star Category” and submit a final verification request. Foodie Admin will conduct a comprehensive review to confirm compliance with professional standards before granting Verified status. Verified Bloggers enjoy enhanced platform privileges, increased visibility, and exclusive collaboration opportunities with vendors and brands.
    • If the materials or information you submit are inaccurate, untrue, non-standard, or if there is a reason for Foodie to suspect them as incorrect, false, or illegal, we reserve the right to refuse to provide you with related functions. As a result, you may be unable to use this platform and related services or may face restrictions on certain functions during use. Your account is your credential for logging in and using the Services. The account is non-transferable, non-giftable, and non-inheritable.
    • When you register and use an account, you must commit and guarantee that:
      1. You take full responsibility for the authenticity, legality, and validity of the registration information, update the registration information promptly, and must not register an account or use the Services on behalf of others;
      2. Safely keep your account and password and take legal responsibility for all activities under that account;
      3. Do not maliciously register accounts, including but not limited to frequent or bulk registration;
      4. Do not transfer, lend, rent, or provide your account to others in any form.
    • Foodie reserves the right, in its sole discretion, to suspend, terminate, or restrict your access to the Services if we believe you have violated any of these Terms, engaged in fraudulent activity, or otherwise acted in a manner detrimental to the integrity of the platform. You may delete your account at any time by following the instructions provided within the platform.
    • If you lose your account, forget your password, or leak your verification code, you can follow the procedure to appeal for recovery in a timely manner. We especially remind you to properly safeguard your account, password, and verification code. After using them, you shall log out securely. You will bear full responsibility for any losses caused by the leakage of your account or password. If bloggers discover any unauthorized use of their accounts, they shall immediately notify us, and we will provide the fullest cooperation and handling.

  1. Blogger Obligations
    • When using the Services provided by Foodie, Bloggers must comply with these Terms, all applicable laws, and platform policies. Bloggers are expected to uphold the integrity of the platform by ensuring their content is honest, original, and aligned with Foodie’s mission to enhance the food community. Bloggers shall not use the platform to infringe on the rights of others, spread misinformation, or engage in deceptive or misleading practices. Content should be fair, balanced, and provide genuine experiences to maintain trust with the audience. Bloggers must respect the rights of Vendors, users, and other platform participants and ensure all interactions remain professional and constructive.
    • Bloggers are expressly prohibited from engaging in the following activities:
      1. Posting false, defamatory, exaggerated, or misleading content, including malicious claims and unverified bad reviews about food vendors, products, or services;
      2. Manipulating engagement metrics such as likes, shares, views, or reviews, including the use of bots, fake accounts, or any deceptive practices to inflate popularity;
      3. Accepting compensation, incentives, or benefits from vendors in exchange for dishonest, biased, or misleading reviews without full disclosure;
      4. Uploading, distributing, or sharing copyrighted content, proprietary information, or any material that violates intellectual property rights without authorization;
      5. Engaging in harassment, discrimination, or hate speech against any individual, group, vendor, or business, including personal attacks or defamatory remarks;
      6. Using Foodie’s platform to solicit personal business deals, unauthorized advertisements, or commercial endorsements that are not explicitly approved by Foodie;
      7. Disrupting or interfering with the normal operation of the platform, including unauthorized data scraping, hacking, or circumventing security measures;
      8. Sharing explicit, offensive, or inappropriate content that violates community standards, including images, text, or multimedia that are not food-related or breach platform guidelines;
      9. Impersonating other users, vendors, or Foodie employees, or falsely representing affiliation with any entity for personal gain or influence;
      10. Encouraging, promoting, or engaging in fraudulent activities such as creating fake vendor reviews, fabricating experiences, or manipulating platform algorithms;
      11. Violating privacy laws by collecting, sharing, or disclosing users' or vendors’ private data without explicit consent;
      12. Any activity that disrupts the balance of the Foodie community, diminishes trust, or negatively impacts the platform’s integrity and credibility.
    • To maintain a reliable and reputable food community, Foodie reserves the right to monitor, review, and moderate content posted by Bloggers. Foodie may use technical means, including automated tools and manual audits, to ensure compliance with these Terms.     • Bloggers are responsible for ensuring that all content created and published on the Foodie platform aligns with the platform’s values and community standards. Content must be original, authentic, and informative, providing users with reliable insights into the food world. Bloggers must not engage in deceptive or unethical practices such as plagiarizing content, fabricating experiences, or misrepresenting vendors, meals, or products. Any form of manipulated content, including AI-generated reviews that mislead users, is strictly prohibited.
    • Foodie encourages diversity in content creation, including restaurant reviews, dining experiences, recipe development, and interactive food-related discussions. However, all content must remain relevant to the platform’s purpose and must not be used for personal disputes, political statements, or unrelated commercial promotions.
    • Any partnerships, advertisements, or endorsements arranged independently between a Blogger and a Vendor must be conducted with honesty and integrity. Bloggers are prohibited from accepting compensation in exchange for misleading reviews or artificially inflating vendor ratings. Failure to disclose sponsorships or engaging in unethical promotional activities may result in penalties, including content removal, suspension, or permanent revocation of Blogger status.
 
  1. Intellectual Property Rights
    • Bloggers retain ownership of the original content they create and publish on Foodie. However, by submitting content to the platform, Bloggers grant Foodie a non-exclusive, worldwide, royalty-free, irrevocable, perpetual license to use, distribute, modify, display, and reproduce their content for promotional, marketing, and operational purposes. This license allows Foodie to highlight Blogger contributions across its platform, newsletters, advertising materials, and social media channels without additional compensation.
    • Foodie respects intellectual property rights and expects Bloggers to do the same. Any unauthorized use of copyrighted materials, trademarks, or proprietary information belonging to third parties without proper attribution or legal authorization is strictly prohibited. Bloggers must ensure they have all necessary rights and permissions for any media, including photographs, videos, and music, incorporated into their content.
    • All intellectual property associated with the platform, including software, algorithms, content, graphics, trademarks, proprietary technology, and unique features such as social networking functionalities, remains the exclusive property of Foodie or its licensors. Bloggers are granted a limited, revocable, non-exclusive, and non-transferable license to access the intellectual property of Foodie and use the platform solely for its intended purposes, subject to compliance with these Terms.
    • Foodie reserves the right to remove any content that violates platform guidelines, infringes upon intellectual property rights, or is deemed inappropriate. Additionally, if a Blogger’s account is suspended or terminated, Foodie may retain published content for archival, legal, or operational purposes, as permitted by law. Bloggers acknowledge that once content is published, other users may interact with or share it, and Foodie is not liable for third-party distribution beyond the platform.
    • Without our permission, you or your end users shall not use any trademarks, service marks, trade names, domain names, website names, company logos (LOGOs), URLs, or other prominent brand features related to the Services, including but not limited to "Foodie”, in any way, either singly or in combination. You are not allowed to display, use, or apply for registration of trademarks, domain names, etc., related to the aforementioned terms in any way, and you shall not perform acts that expressly or implicitly indicate the right to display, use, or otherwise deal with these identifiers to others.
 
  1. Community Standards
    • As representatives of Foodie’s brand and community, Bloggers are expected to engage with users, vendors, and fellow Bloggers respectfully. Constructive criticism and professional discourse are encouraged, but harassment, defamatory remarks, or discriminatory behavior will not be tolerated. Bloggers must refrain from publicly attacking individuals, businesses, or the platform itself in a manner that damages reputation or disrupts community harmony.
    • Bloggers should actively participate in discussions, respond to user inquiries professionally, and contribute positively to the community. Any attempts to manipulate engagement, such as artificially increasing likes, comments, or shares through bots or third-party services, are strictly prohibited and may result in penalties.
    • Foodie reserves the right to investigate complaints or reported violations of these Terms. If a Blogger is found to have engaged in misconduct, the following actions may be taken based on severity:
      1. Removal of non-compliant content without prior notice.
      2. Official warnings or temporary suspension of Blogger privileges.
      3. Permanent revocation of Blogger status for repeated or serious violations.
    • Foodie may also refer violations to law enforcement authorities if they involve illegal activities such as fraud, harassment, or intellectual property theft. Bloggers will be notified of disciplinary actions where applicable, and appeals may be submitted for reconsideration.
 
  1. Data Privacy and Protection
    • Foodie collects and processes personal information related to Bloggers in accordance with its Privacy Policy. This includes, but is not limited to, account registration details, content metadata, engagement analytics, and communication records. Foodie may use this data to enhance platform functionality, improve user experience, and enforce content moderation policies.
    • Bloggers acknowledge that their content, including usernames and publicly shared media, may be visible to other users. Foodie will not sell personal information to third parties but may share data with service providers, affiliates, or legal authorities where necessary for compliance, security, or operational purposes.
    • Bloggers are responsible for safeguarding their account credentials and must take appropriate measures to prevent unauthorized access. Any suspicious activity, such as unauthorized logins or compromised accounts, must be reported to Foodie immediately. Bloggers shall not share their login details with third parties or use their accounts for illicit activities.
    • Foodie reserves the right to temporarily disable accounts in cases of suspected breaches, fraudulent activity, or security risks. In such cases, Bloggers may be required to verify their identity before account restoration.
    • Bloggers may request account deletion at any time; however, certain data may be retained as required by law or for legitimate business interests. Termination of a Blogger’s account does not affect Foodie’s rights to continue using previously published content under the granted license
 
  1. Advertisement Policy
    • Foodie allows Bloggers to publish sponsored content, promotional posts, and advertisements for third-party brands, vendors, and affiliates, provided such content adheres to platform guidelines and applicable laws. Bloggers must ensure that all advertisements, promotions, and paid partnerships are disclosed clearly, transparently, and accurately. Any failure to comply with disclosure requirements may result in content removal, suspension, or termination of Blogger status.
    • Foodie reserves the right to monitor and review all sponsored content to ensure compliance with platform policies and industry standards. Foodie does not endorse, verify, or take responsibility for the accuracy, reliability, or legality of any advertisements posted by Bloggers.
    • Bloggers who engage in advertising or promotional activities must adhere to the following obligations:
      1. Clearly label all paid partnerships, sponsorships, or promotional posts using terms such as “Ad,” “Sponsored,” or “Paid Partnership” to ensure full transparency.
      2. Ensure that all advertisements and endorsements comply with applicable laws and Foodie’s guidelines, including Jordanian consumer protection, and e-commerce regulations.
      3. Represent products and services truthfully without making false claims, misleading statements, or deceptive offers about pricing, eligibility, or product availability.
      4. Avoid engaging in misleading advertising practices, including undisclosed affiliate marketing, manipulated engagement metrics, or artificially inflated brand endorsements.
      5. Refrain from promoting illegal, unsafe, offensive, or inappropriate products or services, including but not limited to alcohol, tobacco, gambling, or any other items prohibited by law.
      6. Obtain necessary permissions before using copyrighted materials, brand logos, or third-party trademarks in promotional content.
      7. Disclose any material relationships with vendors or brands when reviewing or recommending their products or services.
      8. Do not engage in excessive or intrusive advertising tactics, such as spamming, forced redirects, or repeated self-promotion that disrupts user experience.
    • Users and Vendors may report any misleading, offensive, or non-compliant advertisements directly through the platform’s reporting mechanisms. Foodie will investigate and take appropriate action, including content removal or account suspension, within 48 hours of receiving a valid report.
    • Foodie does not guarantee the performance, reliability, or effectiveness of advertisements posted by Bloggers. All advertisements and endorsements reflect the views of the respective Bloggers and do not constitute an endorsement by Foodie. Bloggers are solely responsible for any disputes, claims, or legal consequences arising from their advertising activities.
    • Foodie reserves the right to modify advertising guidelines, impose additional restrictions, or suspend advertising privileges at its sole discretion to maintain the integrity of the platform. Bloggers who repeatedly violate these guidelines may face permanent restrictions on their ability to post promotional content.
 
  1. Disclaimer of Warranties, Limitations of Liability, and Indemnity
    • Nothing in these Terms shall affect any statutory rights that you cannot contractually agree to alter or waive and are legally always entitled to as a content creator and user of the Foodie platform.
    • Foodie provides its platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied. As a Blogger, you acknowledge that Foodie functions solely as an intermediary for content sharing and community engagement and does not assume responsibility for the accuracy, legality, or appropriateness of any content published by Bloggers. While Foodie reserves the right to moderate, remove, or restrict access to content that violates these Terms, it does not guarantee error-free, uninterrupted, or fully secure access to its Services.
    • In response to violations of these Terms, Foodie reserves the right to take measures against you, including issuing warnings, temporarily or permanently suspending your Blogger privileges, restricting platform access, or deleting relevant content without prior notification. We may publicly announce the results of enforcement actions and, at our sole discretion, determine whether to reinstate your Blogger status. In cases involving suspected violations of laws or regulations, Foodie may retain relevant records and cooperate with competent authorities as required by law.
    • You shall be solely responsible for any legal liabilities, claims, demands, or losses asserted by third parties resulting from your content or conduct on the platform. You agree to compensate Foodie for any direct or indirect losses incurred, including legal costs, arbitration fees, attorney fees, investigative expenses, and administrative penalties arising from your actions.
    • o the fullest extent permitted by law, Foodie disclaims liability for:
      1. The accuracy, reliability, or completeness of any Blogger-generated content, including reviews, recommendations, or promotional materials;
      2. Any reputational harm, defamation claims, or third-party disputes arising from content created or shared by Bloggers;
      3. The actions, omissions, or representations of third parties, including vendors, advertisers, sponsors, or external platforms linked through Foodie;
      4. Unauthorized access to or misuse of Blogger accounts, including any resulting data breaches or compromised credentials;
      5. Technical failures, system errors, or service disruptions that impact content visibility, reach, or engagement metrics.
    • You agree to indemnify, defend, and hold harmless Foodie, its affiliates, licensors, and employees from any liabilities, damages, and costs (including reasonable attorneys’ fees) arising from:
      1. Your breach of these Terms or violation of applicable laws and regulations;
      2. Claims by third parties related to your content, including allegations of intellectual property infringement, defamation, privacy violations, or deceptive advertising;
      3. Any fraudulent, unlawful, or unauthorized commercial activities conducted using your Blogger account;
      4. Any gross negligence, intentional misconduct, or misrepresentation that causes harm to Foodie, its users, or its business partners.
    • Foodie reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Foodie’s legal defense. Failure to comply with indemnification obligations may result in immediate suspension or termination of your Blogger privileges.
 
  1. Governing Law and Dispute Resolution
    • These Terms are governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan without regard to conflict of law principles.
    • All disputes arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Central Amman (Qasr Al Adl).

Through Foodie, Bloggers can publish written reviews, post photos and videos, create reels and go live, share personal dining experiences, and provide expert recommendations. The platform also allows Bloggers to interact with users by responding to comments, participating in discussions, and offering insights into food trends, dining options, and must-try dishes. Foodie is not just a content-sharing platform but a social space where food storytelling thrives.
    2. The food vendors you feature, review, or collaborate with through Foodie operate as independent entities. Foodie does not influence the quality, preparation, pricing, or availability of their offerings. Any partnerships, sponsorships, or collaborations between Bloggers and vendors are the sole responsibility of the involved parties. Foodie is not liable for any disputes, misrepresentations, or transactions between Bloggers and vendors, nor does it guarantee any business engagements, incentives, or compensations resulting from such relationships.
    3. While Foodie strives to provide a seamless platform for Bloggers, we make no representation or warranty regarding the continuous availability of the Services. The accuracy of information provided by vendors, users, or other Bloggers is not guaranteed, and we do not take responsibility for inaccuracies, outdated content, or misleading claims. Additionally, the platform may experience temporary downtime due to maintenance, technical upgrades, or unforeseen circumstances beyond our control. Foodie reserves the right to modify, update, or suspend certain features as necessary to improve the user experience or comply with legal and operational requirements.

Account Registration and Security

    1. To join the Foodie Blogger community and contribute to our social food hub, you must meet the following eligibility criteria:
      1. You must be at least 18 years of age or the legal age of majority in your jurisdiction. Foodie fully understands the importance of protecting minors and will take corresponding protective measures in accordance with legal requirements and industry mainstream practices. If it is discovered that an account is being used in violation of this provision, we reserve the right to suspend or terminate the account without notice.
      2.  You must maintain an active Foodie blogger account in good standing, free of violations under the Foodie Bloggers Terms of Use. This includes and ensure that all content, including reviews, recommendations, and ratings, is honest and based on genuine experiences. Interact respectfully and professionally with Vendors fellow bloggers, and the Foodie community. Avoid plagiarism, disclose any sponsored content or partnerships, and maintain transparency in all blogging activities
      3. You must demonstrate a consistent ability to create original, high-quality content that aligns with Foodie’s mission. This includes reviews, Reels, photos, ratings, and other social features that reflect genuine experiences and expertise.
    2. To register as a Foodie Blogger, follow these steps:
      1. Begin by creating a standard Foodie user account. During registration, you are required to provide accurate personal information as outlined in the Privacy Policy, including your first name, last name, email address, phone number, GPS location (for mobile users), and delivery address (if applicable). This information ensures seamless order tracking, personalized recommendations, and secure communication between you, Vendors, and the Foodie team.
      2. After establishing your user account, navigate to the “Profile” menu within the Foodie app. Select the “Upgrade to Blogger” option, which will prompt you to submit a formal request for Blogger status. This feature is designed to distinguish casual users from dedicated content creators. As part of your application, you will be required to submit Your social media profile links to demonstrate your expertise and alignment with Foodie’s standards. Acceptable submissions include: Reels and photos showcasing food experiences, written reviews. The Foodie curation team will evaluate submissions based on originality, visual and editorial quality, and adherence to Foodie’s content guidelines.
      3. Bloggers who demonstrate exceptional engagement and content quality may qualify for Verified Blogger status, a premium designation offering additional benefits.
    3. Users who meet the Verified Blogger eligibility criteria, including order activity and content quality standards, will receive a notification inviting them to apply for verification. To complete the upgrade process, eligible users must navigate to the “Get Verified Profile” section under “Star Category” and submit a final verification request. Foodie Admin will conduct a comprehensive review to confirm compliance with professional standards before granting Verified status. Verified Bloggers enjoy enhanced platform privileges, increased visibility, and exclusive collaboration opportunities with vendors and brands.
    4. If the materials or information you submit are inaccurate, untrue, non-standard, or if there is a reason for Foodie to suspect them as incorrect, false, or illegal, we reserve the right to refuse to provide you with related functions. As a result, you may be unable to use this platform and related services or may face restrictions on certain functions during use. Your account is your credential for logging in and using the Services. The account is non-transferable, non-giftable, and non-inheritable.
    5. When you register and use an account, you must commit and guarantee that:
      1.  You take full responsibility for the authenticity, legality, and validity of the registration information, update the registration information promptly, and must not register an account or use the Services on behalf of others;
      2. Safely keep your account and password and take legal responsibility for all activities under that account;
      3. Do not maliciously register accounts, including but not limited to frequent or bulk registration;
      4. Do not transfer, lend, rent, or provide your account to others in any form.
    6. Foodie reserves the right, in its sole discretion, to suspend, terminate, or restrict your access to the Services if we believe you have violated any of these Terms, engaged in fraudulent activity, or otherwise acted in a manner detrimental to the integrity of the platform. You may delete your account at any time by following the instructions provided within the platform.
    7. If you lose your account, forget your password, or leak your verification code, you can follow the procedure to appeal for recovery in a timely manner. We especially remind you to properly safeguard your account, password, and verification code. After using them, you shall log out securely. You will bear full responsibility for any losses caused by the leakage of your account or password. If bloggers discover any unauthorized use of their accounts, they shall immediately notify us, and we will provide the fullest cooperation and handling.
    8. To delete your account, you may request deletion through the settings section of the Foodie platform. Please note that deleting your account will remove your personal data, though certain information may be retained as required by law in accordance with the Privacy Policy, for the establishment, exercise, or defense of legal claims, or to comply with legal obligations.

Blogger Obligations

    1. When using the Services provided by Foodie, Bloggers must comply with these Terms, all applicable laws, and platform policies. Bloggers are expected to uphold the integrity of the platform by ensuring their content is honest, original, and aligned with Foodie’s mission to enhance the food community. Bloggers shall not use the platform to infringe on the rights of others, spread misinformation, or engage in deceptive or misleading practices. Content should be fair, balanced, and provide genuine experiences to maintain trust with the audience. Bloggers must respect the rights of Vendors, users, and other platform participants and ensure all interactions remain professional and constructive.
    2. Bloggers are expressly prohibited from engaging in the following activities:
      1. Posting false, defamatory, exaggerated, or misleading content, including malicious claims and unverified bad reviews about food vendors, products, or services;
      2. Manipulating engagement metrics such as likes, shares, views, or reviews, including the use of bots, fake accounts, or any deceptive practices to inflate popularity;
      3.  Accepting compensation, incentives, or benefits from vendors in exchange for dishonest, biased, or misleading reviews without full disclosure;
      4. Uploading, distributing, or sharing copyrighted content, proprietary information, or any material that violates intellectual property rights without authorization;
      5. Engaging in harassment, discrimination, or hate speech against any individual, group, vendor, or business, including personal attacks or defamatory remarks;
      6. Using Foodie’s platform to solicit personal business deals, unauthorized advertisements, or commercial endorsements that are not explicitly approved by Foodie;
      7. Disrupting or interfering with the normal operation of the platform, including unauthorized data scraping, hacking, or circumventing security measures;
      8. Sharing explicit, offensive, or inappropriate content that violates community standards, including images, text, or multimedia that are not food-related or breach platform guidelines;
      9. Impersonating other users, vendors, or Foodie employees, or falsely representing affiliation with any entity for personal gain or influence;
      10. Encouraging, promoting, or engaging in fraudulent activities such as creating fake vendor reviews, fabricating experiences, or manipulating platform algorithms;
      11. Violating privacy laws by collecting, sharing, or disclosing users' or vendors’ private data without explicit consent;
      12. Any activity that disrupts the balance of the Foodie community, diminishes trust, or negatively impacts the platform’s integrity and credibility.
    3. To maintain a reliable and reputable food community, Foodie reserves the right to monitor, review, and moderate content posted by Bloggers. Foodie may use technical means, including automated tools and manual audits, to ensure compliance with these Terms. If a Blogger is found in violation of these obligations, Foodie may take corrective action, including content removal, account suspension, or permanent termination of Blogger status. Bloggers must ensure that all content adheres to Foodie’s content guidelines and does not infringe on third-party rights. In cases of reported violations, Foodie reserves the right to investigate and, if necessary, impose appropriate sanctions.     3.  Bloggers are responsible for safeguarding their account credentials and must take appropriate measures to prevent unauthorized access. Any suspicious activity, such as unauthorized logins or compromised accounts, must be reported to Foodie immediately. Bloggers shall not share their login details with third parties or use their accounts for illicit activities.
    4. Foodie reserves the right to temporarily disable accounts in cases of suspected breaches, fraudulent activity, or security risks. In such cases, Bloggers may be required to verify their identity before account restoration.
    5. Bloggers may request account deletion at any time; however, certain data may be retained as required by law or for legitimate business interests. Termination of a Blogger’s account does not affect Foodie’s rights to continue using previously published content under the granted license

Advertisement Policy

    1. Foodie allows Bloggers to publish sponsored content, promotional posts, and advertisements for third-party brands, vendors, and affiliates, provided such content adheres to platform guidelines and applicable laws. Bloggers must ensure that all advertisements, promotions, and paid partnerships are disclosed clearly, transparently, and accurately. Any failure to comply with disclosure requirements may result in content removal, suspension, or termination of Blogger status.
    2. Foodie reserves the right to monitor and review all sponsored content to ensure compliance with platform policies and industry standards. Foodie does not endorse, verify, or take responsibility for the accuracy, reliability, or legality of any advertisements posted by Bloggers.
    3. Bloggers who engage in advertising or promotional activities must adhere to the following obligations:
      1. Clearly label all paid partnerships, sponsorships, or promotional posts using terms such as “Ad,” “Sponsored,” or “Paid Partnership” to ensure full transparency.
      2. Ensure that all advertisements and endorsements comply with applicable laws and Foodie’s guidelines, including Jordanian consumer protection, and e-commerce regulations.
      3. Represent products and services truthfully without making false claims, misleading statements, or deceptive offers about pricing, eligibility, or product availability.
      4. Avoid engaging in misleading advertising practices, including undisclosed affiliate marketing, manipulated engagement metrics, or artificially inflated brand endorsements.
      5.  Refrain from promoting illegal, unsafe, offensive, or inappropriate products or services, including but not limited to alcohol, tobacco, gambling, or any other items prohibited by law.
      6. Obtain necessary permissions before using copyrighted materials, brand logos, or third-party trademarks in promotional content.
      7. Disclose any material relationships with vendors or brands when reviewing or recommending their products or services.
      8. Do not engage in excessive or intrusive advertising tactics, such as spamming, forced redirects, or repeated self-promotion that disrupts user experience.
    4. Users and Vendors may report any misleading, offensive, or non-compliant advertisements directly through the platform’s reporting mechanisms. Foodie will investigate and take appropriate action, including content removal or account suspension, within 48 hours of receiving a valid report.
    5. Foodie does not guarantee the performance, reliability, or effectiveness of advertisements posted by Bloggers. All advertisements and endorsements reflect the views of the respective Bloggers and do not constitute an endorsement by Foodie. Bloggers are solely responsible for any disputes, claims, or legal consequences arising from their advertising activities.
    6. Foodie reserves the right to modify advertising guidelines, impose additional restrictions, or suspend advertising privileges at its sole discretion to maintain the integrity of the platform. Bloggers who repeatedly violate these guidelines may face permanent restrictions on their ability to post promotional content.

Disclaimer of Warranties, Limitations of Liability, and Indemnity

    1. Nothing in these Terms shall affect any statutory rights that you cannot contractually agree to alter or waive and are legally always entitled to as a content creator and user of the Foodie platform.
    2. Foodie provides its platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied. As a Blogger, you acknowledge that Foodie functions solely as an intermediary for content sharing and community engagement and does not assume responsibility for the accuracy, legality, or appropriateness of any content published by Bloggers. While Foodie reserves the right to moderate, remove, or restrict access to content that violates these Terms, it does not guarantee error-free, uninterrupted, or fully secure access to its Services.
    3. In response to violations of these Terms, Foodie reserves the right to take measures against you, including issuing warnings, temporarily or permanently suspending your Blogger privileges, restricting platform access, or deleting relevant content without prior notification. We may publicly announce the results of enforcement actions and, at our sole discretion, determine whether to reinstate your Blogger status. In cases involving suspected violations of laws or regulations, Foodie may retain relevant records and cooperate with competent authorities as required by law.
    4.  You shall be solely responsible for any legal liabilities, claims, demands, or losses asserted by third parties resulting from your content or conduct on the platform. You agree to compensate Foodie for any direct or indirect losses incurred, including legal costs, arbitration fees, attorney fees, investigative expenses, and administrative penalties arising from your actions.
    5. o the fullest extent permitted by law, Foodie disclaims liability for:
      1. The accuracy, reliability, or completeness of any Blogger-generated content, including reviews, recommendations, or promotional materials;
      2. Any reputational harm, defamation claims, or third-party disputes arising from content created or shared by Bloggers;
      3. The actions, omissions, or representations of third parties, including vendors, advertisers, sponsors, or external platforms linked through Foodie;
      4. Unauthorized access to or misuse of Blogger accounts, including any resulting data breaches or compromised credentials;
      5. Technical failures, system errors, or service disruptions that impact content visibility, reach, or engagement metrics.
    6. You agree to indemnify, defend, and hold harmless Foodie, its affiliates, licensors, and employees from any liabilities, damages, and costs (including reasonable attorneys’ fees) arising from:
      1. Your breach of these Terms or violation of applicable laws and regulations;
      2. Claims by third parties related to your content, including allegations of intellectual property infringement, defamation, privacy violations, or deceptive advertising;
      3. Any fraudulent, unlawful, or unauthorized commercial activities conducted using your Blogger account;
      4. Any gross negligence, intentional misconduct, or misrepresentation that causes harm to Foodie, its users, or its business partners.
    7. Foodie reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Foodie’s legal defense. Failure to comply with indemnification obligations may result in immediate suspension or termination of your Blogger privileges.

Governing Law and Dispute Resolution

    1. These Terms are governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan without regard to conflict of law principles.
    2. All disputes arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Central Amman (Qasr Al Adl).

Modifications to Terms

Foodie reserves the right to update or modify these Blogger Terms at any time. Changes will become effective upon posting to the platform. Bloggers are encouraged to review the Terms regularly. Continued use of the Services constitutes acceptance of any updated Terms.

However, before you dive in, it’s essential that you review and understand these Terms & Conditions (the "Terms") that govern your use of the Foodie platform. These Terms establish a legally binding agreement between you and Foodie. By using our services, you agree to comply with these Terms, along with our Privacy Policy, and any additional terms that may apply to specific features of the platform.

  1. Agreement Overview

    1. Foodie products and services are operated by FOODIE LLC, (hereinafter referred to as "Foodie," "we," or "us"). Before using the services, please carefully read and understand these "Foodie Terms of Use" (hereinafter referred to as "these Terms"), along with all related terms, policies, or guidelines available on our platform. These Terms, together with any additional terms for specific features or functionalities ("Specific Terms"), govern your use of Foodie's products and services. In the event of any conflict between these Terms and the Specific Terms, the provisions of the Specific Terms shall prevail.

    2. By registering as a vendor on Foodie and using our platform to list, promote, and sell your products or services, you acknowledge that you have read, understood, and agreed to all terms, including the Foodie Privacy Policy, the Payment Terms and the Refund Policy. You agree to comply with and be bound by these Terms and any future amendments or modifications. If you do not agree to these Terms, you must immediately cease using our Services. Your continued use of the Services constitutes your acceptance of any updated Terms.

    3. Foodie reserves the right, at its sole discretion, to modify or update these Terms at any time without prior notice. Your continued use of the Services after such using the Platform will constitute your acceptance of the modified Terms. Vendors are encouraged to regularly review these Terms to stay informed of any updates or policy changes

    4. To register as a Vendor on Foodie, you must be a legally registered business entity or sole proprietor authorized to sell food, beverages, or related services and provide accurate business registration details, ensuring compliance with all local, national, and industry-specific regulations related to food safety, hygiene, and consumer protection.

Foodie Services

    1. Foodie provides an online platform that enables registered vendors (including but not limited to restaurants, food trucks, bakeries, and specialty food providers) to list and sell their food and beverage products to customers through the Foodie App and website. Vendors can create and manage their online menus, set pricing, receive and fulfill customer orders, and utilize additional platform features such as promotional tools, analytics, and customer engagement.
    2.  In addition to facilitating transactions, Foodie offers vendors access to marketing exposure, including features such as advertising placements, special promotions, and highlighted listings to help vendors reach a broader audience. Vendors may also engage with the Foodie community by responding to reviews, participating in events, and collaborating with food bloggers to enhance their brand visibility.
    3. Foodie acts solely as an intermediary between vendors and customers and does not itself own, prepare, package, or deliver food products. Foodie provides the technological infrastructure and customer support tools necessary for vendors to operate efficiently on the platform but does not assume responsibility for the food quality, hygiene, preparation standards, or delivery performance of vendors.
    4. All vendors registered on Foodie operate as independent business entities and retain full control over their own business operations, including but not limited to menu offerings, pricing, preparation processes, and customer service policies. Vendors are solely responsible for ensuring that their food products and services comply with all applicable health, safety, and business regulations.
    5. Foodie is not liable for any disputes, claims, damages, or legal issues arising from vendor operations, order fulfillment, food safety concerns, delivery mishaps, or customer dissatisfaction. Any disputes between vendors and customers must be handled directly by the vendor in accordance with applicable laws.
    6. Foodie reserves the right to modify, enhance, or discontinue certain features at any time and shall not be held liable for any financial losses, business disruptions, or operational inconveniences resulting from such changes.

Account Registration and Security

    1. To register as a vendor on Foodie and access the platform’s services, you must be a legally registered business entity or individual proprietor engaged in food production, preparation, or sales, and possess the necessary business licenses, health permits, and other regulatory approvals required by local authorities.
    2. By registering on Foodie, you agree to comply with all applicable laws, food safety regulations, and platform policies. If Foodie determines that a vendor is operating without the necessary licenses or, if the materials or information you submit are inaccurate, untrue, non-standard, or if there is a reason for the company to suspect them as incorrect the vendor’s account may be suspended or permanently terminated without notice.
 
    1. To complete your vendor registration, you will be required to submit:
      1. Business registration details, including company name, legal entity type, and tax identification number;
      2. Valid food safety licenses and permits in accordance with local health regulations;
      3. Banking and payment information for receiving payouts;
      4.  Authorized contact details, including business address, phone number, and email address.
    1. Foodie reserves the right to verify and audit the accuracy of the submitted information before approving a vendor’s account. If any documents are found to be false, outdated, or misleading, Foodie may reject the application or suspend an existing vendor account until compliance is met.
    2. Foodie reserves the right, in its sole discretion, to suspend, terminate, or restrict your access to the Services if we believe you have violated any of these Terms, engaged in fraudulent activity, or otherwise acted in a manner detrimental to the integrity of the platform. You may terminate your account at any time by following the instructions provided within the platform.
    3. If you lose access to your account, forget your password, or experience technical login issues, you may submit a verification request to regain access. For security reasons, Foodie may request additional business verification documents before reinstating access.
    4. You are responsible for protecting your account credentials and ensuring that employees or authorized managers using the vendor portal log out after each session to prevent unauthorized use.
    5. To delete your vendor account, you must submit an official termination request through the Foodie Vendor Dashboard or by contacting Foodie support. Deleting your account will remove all active menu listings and vendor services, but some business transaction data may be retained as required by law for financial, compliance, and dispute resolution purposes.
    6. By deleting your account, you acknowledge that you are responsible for fulfilling any outstanding orders, pending refunds, or contractual obligations before termination is finalized.

Vendors Obligations and Restrictions

    1. When using the Services provided by Foodie, Vendors shall comply with these Terms and adhere to all applicable laws, regulations, platform policies, the principles of voluntariness, equality, fairness, and good faith. Users shall not use the service to infringe on the legal rights of others or seek unjust benefits, nor shall they disrupt the normal order of the internet platform. You are required to provide accurate order and delivery information, respect the rights of other Vendors, Users, and Delivery Partners, and ensure timely payment for services.
    2. Vendors are fully responsible for the accuracy of their menu items, pricing, availability, and fulfillment timelines. Orders accepted through the platform must be processed promptly and delivered as per the agreed specifications to maintain service quality and customer satisfaction.
    3. Vendors are expressly prohibited from engaging in the following activities:
      1. Submitting false or misleading business information, including inaccurate pricing, fake discounts, or unavailable menu items intended to manipulate customer choices;
      2.  Engaging in fraudulent transactions, such as processing fake orders, using unauthorized payment methods, or issuing illegitimate refunds to circumvent platform policies;
      3. Manipulating ratings, reviews, or promotions, including submitting fake positive reviews for their own business or posting negative reviews about competitors;
      4. Interfering with platform operations, including unauthorized automation, reverse engineering, hacking, or circumventing Foodie’s security protocols;
      5. Providing unsafe, expired, or improperly stored food, violating food safety regulations or failing to maintain required health and hygiene standards.
      6. Engaging in abusive behavior, harassment, or discrimination against customers, delivery partners, other vendors, or Foodie staff;
      7. Posting inappropriate, offensive, or unlawful content on the platform, including but not limited to content that violates the rights of others, is discriminatory, harassing, threatening, obscene, or defamatory, or promotes illegal activities;
      8. Collecting, using, or disclosing users' personal data in any manner that violates applicable data protection laws or Foodie’s privacy policy, or for purposes other than fulfilling orders or platform-related activities. Vendors must ensure that users' personal data is kept confidential and protected from unauthorized access, use, or disclosure;
      9. Engaging in any activity that could compromise the security of the platform or the privacy of its users, including attempting to access, steal, or manipulate user data without authorization, or using the platform to spread malware or viruses;
      10. Exploiting promotional campaigns by creating fake orders, coordinating mass coupon misuse, or engaging in fraudulent claims for refunds and chargebacks;
      11. Offering or selling unauthorized products or services that are not approved under Foodie’s platform guidelines, including illegal substances or non-food-related items;
      12. Failing to fulfill orders as agreed, including repeated delays, sending incorrect or substandard food, or refusing refunds where applicable under platform policies;
      13. Attempting to bypass Foodie’s transaction system by encouraging customers to complete orders or payments outside the platform, thereby avoiding applicable service fees or commissions.
    4. To ensure compliance and maintain the integrity of the platform, Foodie reserves the right to monitor vendor behavior using technical tools, data analysis, and periodic business audits. Vendors found violating these Terms may be subject to:
      1. Temporary suspension of their vendor account.
      2. Financial penalties or removal from promotional programs.
      3. Permanent termination of their vendor privileges on the Foodie platform.
      4. Legal action in cases involving fraudulent activity, safety violations, or breach of consumer protection laws.

Order Processing and Delivery

    1.  Orders placed through the Foodie platform become binding upon confirmation by the Vendor. Users are responsible for reviewing all order details, including item descriptions, quantities, pricing, and any special instructions, prior to submission. Orders are subject to availability, and Vendors retain the right to decline orders due to stock shortages, technical errors, policy violations, or other operational constraints. By placing an order, users authorize Foodie to share relevant information with Vendors and Delivery Partners to facilitate the transaction. Users must comply with all applicable Vendor policies and any additional requirements specified at the time of placing an order.
    2. Vendors are expected to confirm orders within one (1) minute of receipt. While this is a recommended timeframe, no automatic cancellation occurs if it is exceeded. However, if the Vendor fails to respond, Foodie is required to cancel the order due to lack of confirmation, the cancellation will be processed in accordance with the Refund Policy. Users may cancel orders without charge prior to Vendor acceptance. In all cases, users retain the right to cancel an order within thirty (30) seconds of submission without incurring any fees, regardless of whether the Vendor has accepted the order. After the thirty (30) second window has ended and the order has been accepted, it shall be considered final, and any subsequent cancellation may result in full payment being charged, unless delivery has not yet commenced, in which case only the delivery fee may be refunded.
    3. Requests for modifications or cancellations must be submitted promptly and before the Vendor confirms the order. Such requests are subject to Vendor approval and may result in additional charges. Foodie will notify users of any applicable fees before processing modifications or cancellations. Refunds for canceled or modified orders will be issued in accordance with Foodie’s established Refund Policy, and refund processing times may vary depending on the payment method used. Foodie reserves the right to deduct applicable fees before issuing refunds.
    4. Vendors retain the right to cancel orders at their discretion, including but not limited to instances of inventory shortages, technical failures, or force majeure events. In such cases, affected users will be notified promptly, and any payments made will be refunded in accordance with the refund policy.
    5. Estimated delivery times displayed on the platform are for reference only and are not guaranteed. Various external factors, including weather conditions, high order volumes, traffic disruptions, and unforeseen technical issues, may affect actual delivery times. While Foodie and its Delivery Partners strive to provide timely service, they are not liable for delays beyond reasonable control. Users must ensure that delivery addresses are accurate, accessible, and safe for delivery.

Delivery and Pick-Up Policies

    1.  As a Vendor on the Foodie platform, you are responsible for preparing and fulfilling orders placed by users through the app. Foodie facilitates the delivery process by connecting you with Delivery Partners, but the actual preparation, packaging, and quality of the food items remain under your control. The estimated delivery time provided to users at the time of order placement is an approximation based on factors such as your preparation time, the distance between your premises and the delivery address, current traffic conditions, and other relevant considerations. However, the actual delivery time may vary due to factors beyond Foodie’s reasonable control, including but not limited to: a) Unforeseen traffic delays or road conditions; b) Adverse weather conditions (e.g., storms, heavy rain, or snow); c) Vendor delays in food preparation or fulfillment; d) Delivery Partner delays due to personal or logistical factors.
    2. By using Foodie’s services, you acknowledge and agree that the estimated delivery times provided to users are not guaranteed and are subject to change. Foodie shall not be held liable for delays caused by factors outside its reasonable control. The delivery time estimates are intended for informational purposes only and do not constitute a binding commitment.
    3. To ensure successful delivery of orders, you are solely responsible for ensuring that orders are prepared and ready for pickup by the Delivery Partner within the estimated preparation time. You must verify that the correct items, quantities, and special instructions are included in each order before handing it over to the Delivery Partner, while ensuring that all food items meet the quality and safety standards expected by users and comply with local health and safety regulations, and providing clear instructions to Delivery Partners regarding pickup locations, order details, and any special handling requirements. In the event that a delivery attempt fails due to the following circumstances, Foodie shall have no liability, and you will not be entitled to a refund or any form of compensation: a) Incorrect or incomplete delivery address provided at the time of order; b) User unavailability or failure to respond to the Delivery Partner's attempts to contact you at the delivery address; c) User failure to provide necessary access to the delivery location (e.g., locked gates, inaccessible buildings, or restricted entry points); d) Failure to provide a valid contact number or a reachable point of contact for the Delivery Partner.In such cases, Foodie reserves the right, at its sole discretion, to cancel the order or charge you a cancellation fee. If the order is canceled due to failed delivery, no refund will be issued, unless otherwise specified in our Refund Policy
    1. For orders designated for pick-up ("Pick-Up Orders"), users are responsible for collecting the order directly from the vendor’s premises at the designated pick-up location. You are required to prepare the order and have it ready for collection at the scheduled time. However, you are only obligated to hold your Pick-Up Order for a limited period of time. The following terms apply to Pick-Up Orders:
      1. The vendor will hold the Pick-Up Order for a maximum of thirty (30) minutes after the designated pick-up time.
      2. If the user fails to collect their order within this holding period, you may, at your discretion, choose not to release the order or provide a replacement.
      3. After the holding period expires, you are not obligated to offer any form of replacement, refund, or compensation for any dissatisfaction arising from the user’s failure to pick up the order in time.
      4. Foodie is not responsible for any delays or issues caused by the user’s failure to pick up the order in a timely manner. You agree that Foodie will not be held liable for any loss, damage, or inconvenience resulting from delays in picking up the order.
    1.  Once an order has been submitted and payment processed, it is generally considered final and non-modifiable. However, in cases where modifications or cancellations are permitted, you must act promptly. The following policies apply:
      1. If a user wishes to cancel or modify a delivery order after it has been placed, they must contact Foodie support immediately. Cancellations or modifications to orders may not be possible once you have accepted the order or the Delivery Partner is in route to the delivery location. If cancellation or modification is still possible, Foodie will make reasonable efforts to accommodate the user’s request, but Foodie does not guarantee the ability to cancel or alter an order once it is in progress.
      2. Pick-Up Orders: Once a pick-up order has been prepared by you, cancellations or modifications are not allowed. Users are encouraged to ensure the accuracy of their order before finalizing it.

Price and Payment Methods

    1. As a Vendor, you are responsible for setting the prices of your menu items on the Foodie platform. All prices displayed must include applicable taxes, including sales tax, and any applicable service charges such as delivery fees, where relevant. Pricing may vary based on location, your pricing policies, and promotions. Foodie endeavors to ensure that all listed prices are accurate and up to date; however, if an obvious pricing error is identified, Foodie reserves the right to cancel the affected order and issue a refund to the user, even after order confirmation. Users will be notified of any pricing discrepancies, and in cases where adjustments are necessary, they will have the right to cancel their order before proceeding with the modified amount.
    2. Foodie supports multiple secure payment methods for users, including credit/debit cards and digital platform wallets. Upon order confirmation, the corresponding payment amount is authorized and held in the user’s account until the order is completed. Payments are securely processed through third-party payment providers, ensuring compliance with financial regulations and industry security standards. In cases where payment processing issues arise due to banking restrictions, insufficient funds, or technical errors, the order may be delayed or canceled at Foodie’s discretion.
    3. You are responsible for ensuring that your data, bank account details, menu items and prices are accurate and up to date on the Foodie platform. Foodie does not store sensitive payment information but facilitates transactions through its secure payment processing partners. You must ensure that your access credentials remain confidential and are not shared with third parties. Foodie shall not be liable for any unauthorized transactions resulting from user negligence, including account security breaches or fraudulent activity by third parties.
    4. Refunds, where applicable, will be processed through the Vendor’s virtual wallet.
    5.  Foodie reserves the right to modify its pricing structures, service charges, and available payment methods at any time to reflect operational costs, economic conditions, or changes in Vendor pricing models. Any such modifications will be communicated through platform notifications, and continued use of the service constitutes acceptance of the updated terms.

Reviews and Penalties:

    1. Bad Review Protocol
      1. Vendor acknowledges that maintaining high quality, consistent food safety, and reliable service is critical to Foodie’s reputation.
      2. In the event that a Verified Bad Review is received regarding Vendor’s Menu Items or operational performance, Foodie shall issue a written warning by means of communication for the second occurrence.
      3. Upon the third Verified Bad Review, Vendor’s account shall be suspended on the Platform for a period of three (3) days.
      4. If a fifth Verified Bad Review is received, Foodie shall have the right to immediately terminate the vendor’s subscription without further notice or liability to Foodie.
      5. For the purpose of these Terms “Verified Bad Review” means a user-submitted review regarding Vendor’s performance or Menu Items that, upon investigation by Foodie, is determined to be valid and adverse in nature, as set forth in Foodie’s review and penalty procedures
    1. Price Hike Penalties
      1. Vendor agrees to maintain price consistency between the Menu Items listed on Foodie and those available through other channels.
      2. Should Vendor increase its prices without prior Foodie approval, and if such price increases are verified by Foodie through credible reports, Vendor shall face a penalty consisting of a three (3) day suspension from the Platform for the first occurrence.
      3. A second verified instance of unauthorized price increases shall result in the immediate termination of the vendor’s subscription without further notice or liability to Foodie.

Intellectual Property Rights

    1. All intellectual property associated with the platform, including software, algorithms, content, graphics, trademarks, proprietary technology, and unique features such as social networking functionalities, remains the exclusive property of Foodie or its licensors. As a Vendor, you are granted a limited, revocable, non-exclusive, and non-transferable license to access and use the platform solely for its intended purposes, subject to compliance with these Terms. This license does not grant you ownership of any intellectual property owned by Foodie or its affiliates.
    2. Vendors are prohibited from copying, reproducing, distributing, reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code or underlying components of the platform. Any unauthorized use of Foodie’s intellectual property may result in immediate suspension or termination of access and potential legal action.
    3.  Without our permission, you or your end users shall not use any trademarks, service marks, trade names, domain names, website names, company logos (LOGOs), URLs, or other prominent brand features related to the Services, including but not limited to "Foodie”, in any way, either singly or in combination. You are not allowed to display, use, or apply for registration of trademarks, domain names, etc., related to the aforementioned terms in any way, and you shall not perform acts that expressly or implicitly indicate the right to display, use, or otherwise deal with these identifiers to others.
    4. Vendor-Generated Content: While you retain ownership of the original content you create and upload to the Foodie platform (e.g., menu descriptions, photos, videos), you grant Foodie a non-exclusive, perpetual, royalty-free, worldwide license to use, reproduce, modify, distribute, and display such content for the purposes of operating and promoting the platform. This includes the right to feature your content in marketing materials, social media posts, and third-party collaborations.

Non-Compete and Non-Disclosure:

    1. Vendor acknowledges and agrees that during the term of their subscriptions on the platform and for a period of five (5) years following final termination (the “Non-Compete Period”), Vendor shall not, directly or indirectly, engage in, assist, develop, launch, or participate in any service, platform or activity that is similar or utilizes in any way the proprietary concept, functionality, or overall user experience of the Foodie Platform.
    2. Vendor further agrees not to disclose or use any confidential or proprietary information of Foodie for the benefit of any competing business.
    3. Vendor may list, market and sell its products through other channels as long as such activities do not result in a breach of the Vendor’s non-compete obligations set forth in this section.
    4. In the case of the violation of these non-compete provisions, Foodie also reserves the right to seek any and all other legal remedies available, including but not limited to injunctive relief, damages, and any other remedies to enforce the terms of this Agreement.

Data Privacy and Protection

    1. Vendors shall comply with all applicable provisions of the Jordanian Personal Data Protection Law No. 24 of 2023 and its amendments (the “PDP Law”) in connection with the Processing of Personal Data under this Agreement.

    2.  Any Personal Data exchanged or processed in connection with this Agreement—including for KYC and order fulfillment—shall be processed lawfully, fairly, and transparently. The processing shall be limited solely to the purposes specified in this Agreement and consistent with the PDP Law.

    3. Vendors shall implement and maintain appropriate technical and organizational measures to protect Personal Data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. Foodie shall ensure that its systems incorporate state-of-the-art security measures, and Vendor shall, as reasonably required, adopt compatible safeguards.

    4. Any transfer of Personal Data outside the Kingdom of Jordan shall only occur if the recipient provides an adequate level of protection as required by the PDP Law. No such transfer shall be made without ensuring that appropriate safeguards are in place.

    5. Personal Data shall not be retained longer than necessary for the purposes for which it is processed. Upon completion of such purposes or upon termination of the vendor’s subscription, Personal Data shall be securely deleted or anonymized in accordance with the PDP Law.

    6. All Personal Data exchanged between Foodie and the Vendors shall be deemed Confidential Information and shall be handled in strict confidence in accordance with the confidentiality provisions set forth elsewhere in these terms and the requirements of the PDP Law.

Advertisement Policy

    1. Foodie may display advertisements from third-party partners, sponsors, or affiliates (“Advertisers”) as part of its services. These advertisements may appear on the platform, in emails, or within other communications. As a Vendor, you may also have the opportunity to participate in promotional campaigns or sponsored content initiatives, subject to separate agreements with Foodie.
    2. Advertisers are solely responsible for:
      1. Ensuring their content complies with all applicable laws related to consumer protection, and e-commerce regulations.
      2. Accurately representing products/services and disclosing material terms (e.g., pricing, eligibility).
      3. Labeling sponsored or promotional content clearly (e.g., using “Ad,” “Sponsored,” or “Promotion”).
    3. If you encounter misleading, offensive, or illegal advertisements on the Foodie platform, you may report them directly through the platform’s reporting tools. Foodie will investigate and remove non-compliant ads within 48 hours of receiving a valid report.
    4. Foodie does not endorse Advertisers or their products/services. We are not liable for disputes arising from third-party advertisements, including but not limited to claims of false advertising, product defects, or service failures.

Termination of the Vendor’s Subscription:

    1. Upon termination or expiration of this Agreement for any reason:
      1. Vendor shall immediately cease offering Menu Items on the Foodie Platform;
      2.  Vendor shall fulfill all pending orders and contractual obligations arising prior to the termination date;
      3. Foodie shall remit any outstanding payments to Vendor for orders completed prior to termination, subject to any applicable deductions for refunds, chargebacks, or penalties;
      4. Vendor shall promptly return or destroy all Confidential Information of Foodie in its possession; and
    2. Termination of this Agreement shall not entitle Vendor to any compensation, damages, or reimbursement for lost profits, whether or not such losses were foreseeable, arising from the termination. Furthermore, Vendor shall be liable for any losses, costs, or damages incurred by Foodie as a result of Vendor’s breach or any grounds for termination under this Agreement, including but not limited to legal fees, reputational harm, and operational disruptions.

Disclaimer of Warranties, Limitations of Liability, and Indemnity

    1. Foodie provides the platform “as is” and makes no representations or warranties of any kind, express or implied, regarding its functionality, reliability, or suitability for your business needs. To the fullest extent permitted by law, Foodie disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
    2. In response to your violation of these Terms or other service terms, Foodie reserves the right to independently judge and take measures against you, including issuing warnings, setting deadlines for correction, restricting account functions, suspending usage, closing accounts, prohibiting re-registration, deleting relevant content, etc., without the need for prior notification. We have the right to announce the results of the actions taken and, based on the actual circumstances, decide whether to restore usage. For behaviors suspected of violating laws and regulations or involving illegal activities, relevant records will be retained, and reports will be made to the competent authorities in accordance with the law, cooperating with their investigations. You shall be solely responsible for any legal liabilities, claims, demands, or losses asserted by third parties resulting therefrom, and you shall compensate us for any losses incurred, including litigation fees, arbitration fees, attorney fees, notary fees, announcement fees, appraisal fees, travel expenses, investigation and evidence collection fees, compensation, liquidated damages, settlement costs, and administrative fines incurred in protecting our rights.
    3. Foodie acts solely as an intermediary platform. To the fullest extent permitted by law, we exclude liability for:
      1. Food quality, preparation, or safety.
      2. Delivery delays, errors, or damages caused by Delivery Partners or external factors.
      3. Third-party actions, including Advertisers or linked websites.
      4. Indirect, consequential, or punitive damages.
      5. The Vendor’s misuse of user data or any violation of applicable data protection and privacy laws, including unauthorized access, use, or disclosure of personal information provided by users.
      6.  Inappropriate, offensive, or unlawful content posted by the Vendor on the Platform, including content that violates the rights of users or third parties, or that is discriminatory, defamatory, or harmful to the reputation of Foodie or other users
    4. You agree to indemnify, defend, and hold us and our affiliates and licensors (if any) harmless against any liabilities, damages, and costs (including reasonable attorneys' fees) payable to a third party arising out of a breach by you or any user of your account of these Terms, your violation of all applicable laws and regulations or third party rights, your fraud or other illegal acts, or your intentional misconduct or gross negligence, to the extent permitted by the applicable law.

Governing Law and Dispute Resolution

    1. These Terms are governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan without regard to conflict of law principles. All disputes arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Central Amman (Qasr Al Adl).
    2. Before initiating legal action, parties agree to attempt resolution through good-faith negotiation or mediation. If such efforts fail, disputes may proceed to arbitration or litigation as determined by applicable law.

Modifications to Terms

Foodie reserves the right to update or modify these Terms at any time. Changes will become effective upon posting to the platform. Vendors are encouraged to review the Terms regularly. Continued use of the Services constitutes acceptance of any updated Terms.

Acknowledgment and Agreement

By using the platform, you confirm that you have read, understood, and accept these Terms. You agree to comply with all obligations and acknowledge the legally binding nature of this agreement. Failure to adhere to these Terms may result in suspension or termination of access and potential legal consequences.
