Use of Your Information

Foodie utilizes Personally Identifiable Information to establish user accounts, communicate with users about Foodie services, offer additional services, promotions, and special offers, and process payments for purchases made through Foodie. Foodie may share collected Personal Identifiable Information with third-party vendors and service providers who assist in providing application programming interfaces (APIs) and other functionalities for the site in connection with Foodie services. Furthermore, Foodie shares users' order details, special instructions, first and last names, street addresses, and telephone numbers with restaurants to the extent necessary for processing orders. Foodie may also disclose Personal Identifiable Information to third parties, such as attorneys, collection agencies, courts, or law enforcement, in response to valid requests related to alleged violations of Foodie's terms of use or other contractual breaches, infringements, or similar issues. User-generated content posted on the app, such as reviews of services and restaurants, as well as certain social media preferences (e.g., pages you "Like" or "Recommend"), may be visible to the public. Therefore, Foodie cannot guarantee the privacy of any Personal Identifiable Information included in such user-generated content. Since Non-PII does not identify you personally, we may use this information for any purpose. We also reserve the right to share such Non-PII, which does not personally identify you, with our affiliates and other third parties for various purposes. Foodie uses IP addresses to calculate site usage levels, diagnose server issues, and administer the site. Additionally, we may use and disclose IP addresses for the same purposes as PII. Please note that we consider IP addresses, server log files, and related information as Non-PII, unless we are required to treat them otherwise under applicable law.

Creating an Account for the foodie app

Users can create an account on the App and choose their own "username" and "password." The username is unique to each User. The password is known only to the User, who can change it at any time. It is the User's responsibility to select and protect their password. Foodie is not liable for any issues arising from password use. Foodie may share your username and password with third-party companies to provide our Service. Users must enter their username and password, a process known as "login." By using this app, you warrant that all personal information provided is true, accurate, current, and complete. You agree to notify us immediately of any changes by updating your User profile on the app or by contacting us directly. You also agree not to impersonate any person or entity or use a name you are not authorized to use. Users are not permitted to register multiple Accounts for personal use. Violating this rule may result in account termination. Users must keep their passwords confidential and not share them with anyone. You are responsible for all activities and orders made through your Account. If you believe someone may know your password, contact us immediately. You may not use the app for any unlawful or unauthorized purpose, including but not limited to: Distributing any unlawful, libelous, abusive, threatening, harmful, obscene, or otherwise objectionable material. Transmitting material that constitutes a criminal offense, results in civil liability, or breaches any laws, regulations, or codes of practice. Interfering with others’ use or enjoyment of the app. Damaging, disabling, or impairing the operation of the app or attempting to gain unauthorized access to the app or networks connected to it through hacking, spoofing, or similar means

Our Services

The app allows Users who agree to the Terms to order from partnered restaurants, vendors,  (hereinafter referred to as the "Vendors"). The purpose of this app is to provide a simple and convenient service that connects Users with Merchants in their area for delivery (our "Service"). Users can order a variety of goods, including prepared meals, beverages,  Interactive options enable Users to build and submit orders with just a click. When you place an order from a vendor , Foodie acts as a facilitator on behalf of that Merchant to complete your order through the app and to manage your experience throughout the order process. We have created the app to serve as a social food hub for its Users. Foodie does not sell or interfere in any way with the production of goods or services offered by the Vendors. Vendors are obligated to comply with local laws, rules, regulations, and standards pertaining to the preparation, sale, marketing, and safety of goods and services.< Foodie and the Vendors endeavor to comply with your special instructions for an order. However, in cases where it is not feasible or commercially reasonable to do so, Foodie and/or the vendors reserve the right to prepare the order according to standard operating procedures. Neither Foodie nor the vendors shall be responsible for replacing or refunding an order that does not conform to your special instructions. Foodie shall not be liable for any goods and services offered by vendors that are unhealthy, cause injury, are otherwise unacceptable to Users, or do not meet Users' expectations in any way. Users are solely responsible for verifying the accuracy of delivery addresses, and Foodie shall have no liability for erroneous addresses. All preparation and delivery of goods and services are the sole responsibility of the vendor accepting the order. Please note that while the vendor will do everything possible to meet the specified delivery time, delivery times may be affected by factors beyond their control and cannot be guaranteed. We will inform you if we become aware of any unexpected delays.

Order Cancellation

You can cancel an order for a full refund as long as it has not yet been accepted by the vendor. If you need to cancel after the order has been accepted, please contact us via the chat function on the Foodie app. Foodie reserves the right not to issue full or partial refunds for orders canceled after acceptance. Additionally, a Vendor may cancel an order even after you have received confirmation that it has been sent to them. Foodie and our partner Vendors retain the right to cancel any order, before or after acceptance, and will notify you immediately of any such cancellation.

Delivery

You understand that the availability of goods offered by Foodie may vary by delivery area. By entering your delivery address on the App, you will see the Vendors available to you at that time. Delivery areas may expand, shrink, or change due to various conditions such as weather, traffic, and force majeure situations. Foodie will deliver your Order to the address you provide. An estimated delivery time will be included in your email confirmation and on the order tracking page. However, delivery times can vary due to uncontrollable factors, including order quantity, distance, time of day (peak periods), weather, and traffic conditions. You can check the remaining delivery time of your Order by clicking on "Orders icon" on the app. You acknowledge that the provided delivery time is only an estimate, and Orders may arrive earlier or later. To ensure successful delivery, either you or someone else should be available at the delivery location to receive the Order once it is placed. Without limiting any other clauses in these Terms, if we attempt to deliver an Order but are unable to due to reasons caused by you—such as: No one being present to receive the Order Customer being uncontactable despite attempts to reach them via the provided phone number Lack of appropriate access for successful delivery Lack of a suitable or secure location to leave the Order We will contact you via in-app call, message, or email to inform you of the unsuccessful delivery and the next steps. In such cases, Foodie reserves the right to cancel the Order without offering a refund If you remain uncontactable or fail to receive the Order within a reasonable time from when it arrives at your delivery address, Foodie reserves the right to cancel the Order without a refund . Wrong Order, Missing Order, Defective Items: Upon receiving your Order, if you discover any issues (e.g., wrong items, defective items, or missing items), please contact customer support through our in-app customer support chat feature immediately. Foodie may request photographic proof and/or additional information to investigate the issue. If we find that the Order and/or goods received are not satisfactory in condition or quality, we will compensate you for your Order or parts of it. If your Order is significantly delayed beyond the estimated delivery time, please contact customer support through our in-app chat feature immediately. Foodie may ask for additional information to investigate the issue. If we determine that the Order and/or goods you received are significantly delayed, we will compensate you for your Order. As an option, customers may choose contactless delivery (where the Order is left at the front door of a specified delivery address without face-to-face interaction) . Foodie is not liable for theft, damage, contamination, or deterioration of the goods that occur after delivery has taken place.

Pick-up Process

you will have the option to collect your Order in person directly from the vendor's premises ("Pick-Up") instead of having it delivered. The status of your Order, including the time for pick-up ("Pick-Up Time"), will be displayed in the Order screen within the Foodie app. The vendor will prepare your Order by the Pick-Up Time Please note that, in some cases, a reasonable delay may occur. The vendor agrees to hold your Order at their premises for no longer than thirty (30) minutes from the Collection Time ('Holding Time'). If you fail to pick up your Order within the Holding Time, the vendor is not obligated to provide the Order to you.

Pick-up Liability

If you experience unreasonable delays in Pick-Up, you bear the risk of any damage ,as well as any deterioration in quality  (e.g., temperature changes affecting fit for consumption). In such cases, you will not be entitled to a refund or replacement of the order. You are solely responsible for a inspecting the Order when you Pick-Up your Order and must report any issues or defects to the vendor before leaving their premises.

Your Responsibilities

During your use of the services on the app, you accept and undertake the following responsibilities: You confirm that all information provided to us is correct. You are solely responsible for any losses that may arise from misinformation or inadequate information (e.g., forgetting your password). Content Responsibility: You are solely responsible for all personal ideas, opinions, and statements you express while using the app. This includes any files uploaded and personal information sent. Foodie shall not be held liable for any such content. You shall not modify the software or use altered software, and you agree to indemnify Foodie for any material or moral losses resulting from non-compliance with these terms. You may not access or use the app for any other purpose other than that for which the app makes it available. In case of any prohibited activities committed by the user, the company has the right to suspend, block, or terminate the user's Account and prevent his access to log in to the service. Prohibited Conduct: You agree not to: Objectionable, offensive, indecent, harassing, threatening, embarrassing, distressing, vulgar, hateful, racially, ethnically, or sexually offensive, or otherwise inappropriate behavior towards the Foodie personnel. Send threatening, immoral, or racially inappropriate messages. Harass or threaten other users or a personnel. Post or circulate amoral, inappropriate, or unlawful materials. Advertise, sell, or offer products or services without consent. Send harmful information or programs to other users' devices. User Data Consent: You acknowledge that any records or materials obtained through the use of Foodie's services are done with your consent. You are responsible for any damages, loss of information, or other losses caused by your actions. Commercial Use: You shall not use the services for commercial or advertising purposes without Foodie's consent. Foodie reserves the right to monitor its systems at any time. Legal Use: You agree not to use the app for illegal purposes or to infringe upon any rights associated with the content on the app. System Security: You agree not to attempt to gain unauthorized access to other computer systems through the app, interfere with another person's use of the app, or upload harmful files.

Authority of Foodie

Foodie may temporarily suspend or completely halt system operations at any time. The app holds no liability to Foodie users or third parties for any temporary suspension or full cessation of services. Foodie does not guarantee that services will be provided on time, securely, or in a complete manner. Foodie reserves the right to back up and delete all or some files and messages provided by users while using the services at intervals determined by the app. Foodie is not responsible for any loss of data during these processes. The app owns the rights to the information, documents, software, designs, and graphics it creates or acquires. Foodie is not liable for any items ordered but not delivered by a vendor due to unavailability. Foodie has the right to post user-generated content (e.g., reels, photos) uploaded to the app and share or redistribute it within the system as deemed appropriate. This content may be copied or reposted by other users, and in such cases, users cannot claim any royalties from Foodie. The responsibility to update product information, including pricing and specifications, lies with the companies that have online stores on the app. In case of any incorrect information, Foodie may cancel orders to correct mistakes. The app may be unavailable at times for maintenance and upgrades. Although efforts will be made to inform users in advance, Foodie reserves the right to modify or withdraw services without prior notice.

Termination of Agreement

Foodie reserves the right to terminate, suspend, or delete your account and restrict your access to or use of the app, including any delivery services provided for an order, for any reason. Foodie will give you the opportunity to present your case before terminating, suspending, or deleting your account.

Refund Policy

Foodie takes user satisfaction very seriously. If you encounter any issues with your order, please reach out to Foodie through our live chat, and we will assist you. In appropriate cases, if you have already been billed by Foodie on behalf of the Vendor, Foodie will issue full or partial refunds. For example, if you did not receive your order, you may be eligible for a full refund; if part of your order is missing, a partial refund may be issued. In all cases, we will consider relevant factors, including the specifics of the order, and do our best to ensure your satisfaction.

Price and Payment

Once your order is accepted, it represents an agreement between you, the user, and the vendor. The vendor is solely responsible for fulfilling the order. All online payments are processed through your payment service provider or card issuer, in partnership with Foodie's payment service providers. Prices shown on the platform are displayed in the local currency of the applicable country and are subject to any applicable taxes. The way prices are displayed on our app may vary depending on the vendor and, subject to applicable laws, may reflect adjustments. Prices and additional charges (such as delivery, or service fees) shown on the app are valid at the time of each order and may change later. Foodie reserves the right to charge these fees as deemed necessary for business operations. A breakdown of prices and additional charges will be displayed before checkout, and by placing an order, you agree to all displayed amounts, fees, and the final total.

Payment Methods

When using your account as a payment method, you can select from the available payment options on the platform. Foodie reserves the right to add or remove payment methods at its sole discretion. If you choose to pay using an online payment method, the transaction will be processed by our third-party payment service provider(s). With your consent, your payment details (such as credit card information) may be stored with these providers for future orders. Foodie does not store your credit card or payment information. It is your responsibility to ensure sufficient funds are available on your credit or debit card to complete the payment for an order. Foodie takes responsibility for payments made through the app, including refunds, chargebacks, cancellations, and dispute resolution, where applicable,  and in accordance with these terms. Online payment via debit or credit card is also available and may be the only payment option for certain restaurants. For online debit or credit card transactions, we securely transmit your full card information to the relevant debit or credit card company in an encrypted format, adhering to globally accepted protocols during the order processing. If you choose, we can retain a portion of your card information in an encrypted format, taking care to implement physical, electronic, and procedural safeguards to protect your credit card information.

Rider Tips

When you place an order on the platform, you will have the option to pay a tip to the rider assigned to deliver your order ("Rider Tip"). Foodie will collect the payment for the Rider Tip using the payment method you select for the order. The rider will receive the full amount of the Rider Tip you choose to give after the delivery is completed. If your order is canceled before delivery, Foodie will refund the Rider Tip to your Foodie wallet Rider Tips are non-refundable once the rider has successfully delivered the order. For any questions or concerns regarding your Rider Tip, please contact our customer support team via email or through the in-app chat feature available on the app.
